Mr. Paul Yen
June 19, 1995
Page 2

Street. E1 Camino Real (State Route 82) is a major thoroughfare
traversing the City in a generally northerly/southerly direction,
which intersects approximately three blocks northerly from the
Property with Woodside Road (State Route 84) another major
thoroughfare traversing the City in a generally easterly/westerly
direction.

4. Appellant applied for a modification to the existing use
permit to allow entertainment, in the form of dancing accompanied
by amplified music, in conjunction with which the operating hours
of Appellant's establishment would be extended to 2:30 a.m.
Appellant's application was heard by the Zoning Administrator at
a public hearing on March 15, 1995, subsequent to which, on April
5, 1995, the Zoning Administrator denied the application upon
stated findings (Determination of Zoning Administrator, April 5,
1995). Timely appeal was taken by Appellant (Letter of Appeal
dated April 12, 1995).

5. On appeal, Appellant proposed to modify the operating
hours pertaining to the entertainment/dancing use by providing
for a closing time of i a.m. instead of 2:30 a.m. (Letter of
Appeal dated April 12, 1995). Further, Appellant proffered a
proposed plan of operation which would provide for varying types
of entertainment relating to style of music and/or patronage
(viz., "Senior Night," "Country and Western," "Top-Forty"; see,
plan of operation entitled, "R.C. Savoy's House of Buffet," page
3). Appellant's proposed operation contemplates use of valet
parking to allow for more intensive use of Appellant's existing
on-site parking lot (id. at page 4).

6. The Property is located in an area which, in the past,
has been notorious for its acti~r~ties involving prostitution and
drug trafficking. A neighborhood association comprised of
residen%s and business operators in the vicinity of the Property
has worked in conjunction with City personnel, including the
Police Department, to improve living conditions relating to the
residential areas surrounding the Property. Such efforts have
included the establishment of a drug-free zone in a neighborhood
park in the vicinity of the Property, and aggressive prosecution
of offenses relating to drug trafficking, and alcohol abuse.

7. In or about 1988, when the Property was owned by a
predecessor in interest to Appellant, a dance permit had been
issued by the Police Department for use in conjunction with a
then-existing restaurant. During the one-year period involved,
the Police Department received some twenty-nine calls for service
relating solely to the Property including offenses involving
drugs, alcohol, disturbance of the peace, and prostitution.
