Appellant proposes, in conjunction with the expanded <br /> use, to sell alcoholic beverages for consumption on-site (Plan of <br /> Operation, page 5). <br /> <br /> 9. Under Appellant's current operation, Appe!lant's on-site <br /> parking facilities have been frequented by prostitutes and, from <br /> time to time, have become unsightly from debris and general lack <br /> of upkeep. <br /> <br /> 10. Patrons of the Property and/or of commercial <br /> establishments in the vicinity thereof, frequently use the <br /> interior, residential streets for vehicular access to Woodside <br /> Road. Such use burdens the residential nature of said interior <br /> streets and the residential uses appurtenant thereto. <br /> <br /> 1!. The use proposed by Appellant would extend the <br /> patronage of Appellant's Property into early hours of the <br /> morning, inconsistent with the adjoining commercial and <br /> residential property uses. Said proposed use would increase the <br /> intensity of use intensively of the on-site parking facility and, <br /> most probably, would require Appellant to obtain permission to <br /> use adjoining properties for parking purposes. Said more <br /> intensive and expanded parking use would necessarily increase <br /> sound levels associated with patrons arriving at, and departing <br /> from, the Property, all during hours inconsistent, and <br /> incompatible, with surrounding residential property uses. <br /> <br /> 12. The proposed hours of operation, together with <br /> consumption of alcoholic beverages on-site, would result in noise <br /> levels and behavior inconsistent with the residential and <br /> commercial uses of surrounding and neighboring properties. The <br /> increased hours of operation and increased patronage, together <br /> with consumption of alcohol, would also attract prostitution and <br /> drug trafficking known to occur in the area, with detrimental <br /> effect upon the existing commercial and residential property uses <br /> adjacent to, and in the vicinity of the Property. <br /> <br /> 13. By reason of the foregoing, the proposed expanded use <br /> would be detrimental to the health, safety, peace, morals, <br /> comfort, and general welfare of persons residing and working in <br /> the neighborhood of the Property and would be detrimental and <br /> injurious to property and property improvements in the <br /> neighborhood of the Property and to the general welfare of the <br /> City (Zon.Ord. § 42.3). <br /> <br /> <br />
