The Customer agrees tt�at Perfect Parbes, USA has the right immediatety remove or shirt dowo ihe artificial ice rink or any related
<br /> equipment, or W stop providing entertainment seivices if it observes or becomes aware [hat the artificial ice rink or any related
<br /> equipmem is being misused, or [hat any unsafe condition(s) e�cisu. If an attraction or an event is shut down due to misuse of
<br /> equipment or ihe existence of any unsafe condition(s), the Customer agees and �mderstands [hst Perfect Paities, USA will not, and is
<br /> not obligated to provide any refund, credit, rescheduled services or discount to the (,l�stomer. The term "wsafe cond'aion" as used in
<br /> this contraat includes, but is not limited to, inclement weather and wind speeds that exceed 25 miles per hour, acts of god, andlar the
<br /> manufacturer's recommenda[ions or requirements.
<br /> Perfect Parties, USA cares.for the artificial ice rink by spraying it with a solution that reduces friction and enhances glide and speed
<br /> The solution is a food �ade product that is � 100% water soluble and non-touic. There are inherent risks that the solution may over
<br /> spray the ice surfece, be tracked from or by operators or patrons, or leak througJ� the top of s�¢face resulting in solution residue un the
<br /> floor. These circums�ances are unlikely and �uousual and the solution will not stain or damage any flooring surface but will.require
<br /> clean up. Pedect Pazties USA is not cesponsble for floor clean up. G�stomer is advised to provide plas[ic sheeting under the artificial
<br /> ice rink surface as detailed in Section 2.
<br /> 13. Extending Rental: Oveitime rates will be pro-rated based on the original durntion and price and xhall be charged for each hour or
<br /> portion theroof for equipment kept in operation beyond the scheduled�end�time.
<br /> 14. Skill: Ice skating on [he artificial ice rink cequires an element of ski1L Our product has been scientifically researched to only
<br /> pre�duce�7% more resistance than skating on refrigerateA ice. T'he skate-ability of the sw'face is not a subjective experience. Perfect
<br /> Parties, USA makes no claims to and is not responsible for inj�ies obtained or suslained on the artificial ice rink.
<br /> I5. Photos: The Customer acknowledges thaz photos of the artificial ice rinks are the property. of Perfect Vazties, USA and copying,
<br /> distributing, pubGshing by the Customer or any of its affiliates or subsidiarics is not permitted wi[hou[ exp�ess written consent from
<br /> Perfect Parties, USA. Notwithstanding the�above, photos of inembers of the public using the skating rink aie the proper[y of the Ciry
<br /> and will be su6ject to the terms of the City's photo policy.
<br /> 16. E�cterior Decorations, Pencing and Props: The Cus[omer aclmowledges that they have contracted with Perfect Parties, USA for the
<br /> arti5cial ice rink and related materials onty unless ot6erwise agreed and amended to ttie contract. The Customer is responsible for any
<br /> and all e�cterior and interior decorations and/or props. Perfec[ Parties, USA is not responsible for the installa[ion or removal of, or
<br /> damage to any and all decotations ur props. Perfect Pariies, USA reserves the right to remove the artificiel ice rink if any decorations
<br /> or props provideA by the Customer appear ro have the po[ential to be destruc[ive to Perfect Parties, USA's public image or sugges[
<br /> potential damage to the artificial ice rink. Perfect Pacties, USA is�not liable or rospoasible for any damage to the artificial ice rink oi
<br /> personal injury resutting from 3rd parry props or d�cor.
<br /> Pedect Parties, USA ptoyides perimeter fencing for all artificial ice rinks unless otherwise no[ed.� Website and marketing materials�
<br /> highlight various sryles of perimeter fencing to include white picket fencing, aetting, black barricades, etc. The fencing provided is not
<br /> debatable or an op[ion to be speci6ed or selected by the Cus[omer uuless such structure violates a promulgated building, fve or other
<br /> applicable law or code enac[ed by a publicagency. No style or color of fencing will be gusranteed by Perfect�Par[ies, USA. Perfect
<br /> Parties, USA is no[ responsible for which perimetei fencing is provided to the Cusmmer.
<br /> 17. Inability to Perfortn and L'unita[ion of Liability: In the iml�lcely event that Perfect Parties, USA is imable to provide an aurae:tion,
<br /> Perfect Parties, USA will make every effort to provide an accePtab�e reP�uement. �f a replacement cannot be provided, Perfec[
<br /> Parties, USA will refimd lhe poition of tNe deposi[ paid prorated to the number of at6actions that were provided. However, the
<br /> Cus[omer agrees that said refund will be the full ex[eat of damages tt�e Customer is en[itled to, and that no fiuther damages of any
<br /> kind will be sought by the Ctistomer a�ainst Perfect Parties, USA.
<br /> In the unlikely event that PerfeM Parties, USA is delayed and tfie even[ does not start at the agreed upou and contracted time or within
<br /> one hour of, or time is lost during the event due to the malfunccion of the rental properry, Perfect Parties, USA will refund the portion
<br /> of fees paid prorated to t6e time lost. Nowever, the Cus[omer agrees diat said refund will be [he full extent of damages tFie Customer is
<br /> entitled to, and that no fuRher damages of any kind will be sought by the Customer againsC Pedect Parties, USA.
