<br /> other requ'vemenu regarding who�may use the rink and any emergency procedm'es. Perfect Pardes, USA also agees to provide
<br /> tmining and instruMion regarding the manufacturer's specifications for the erec[ion the artificial ice.rink. Perfect Par[ies, USA will
<br /> da:ument that said haining hes taken place, who has participated in said training and what documents were providad as part of said
<br /> training.
<br /> It is the Cusromer's respoasbility to make all desi�ated operators available for the above-menlioned training in the manner set forth
<br /> in the attached Rider A, which is incorporazed herein and made a part of this ageemem by reference, prior to the opening of the
<br /> artificial ice rink for use, and ro ensure that all�opetatots that moni[or the artificial ice rink at the event have satisfactorily completed
<br /> said training. If the Customer or its designated operetors do not report for the required training, Perfect Parties, USA reserves the right
<br /> to delay set-up or opening of the artificial ice rink until sufficient training has been given. Pedect Parties, USA aLso reserves the righc
<br /> in i[s sole discretion to reject any operators provided or designated by the Cus[omer. The Cuslomer agrees that Perfect Parties, USA is
<br /> not responsible for any financial loss or damage [o tfie Castomer due to an insufTicient number of operetors being available, or due to
<br /> iusufficient time being available [o train operators.
<br /> By signing this agreemeny the Customer agrees d�at any artificial�ice rink operntors provided or designated by the Customer are over
<br /> eighteen years of age, ar�d are its designees authorized to receive [6e above instrudions and training on its behalf, and lo sign the
<br /> aaached Rider B and any Opetator Training Documentation forms provided by-Perfect Parries, USA, which are posted online at
<br /> www.artificialiceevenu.com under downloads and made a part of this agreemecrt by reference, on the Customer's behalf. 'Itle
<br /> Clisiomer understands and agrees that both the Customer and irs designated operators are obligated.by this agreement to abide by all
<br /> of the [ertns, conditions, rules, manufacturer's instruc[ions and training provided by Perfect Parties, USA.
<br /> 9. Serious Injury: In [6e event of serious injury involving the artificial ice rink, the Cus[omer shall be responsible for securing the
<br /> artificial ice rink and making it accessitile to applicable public safety officers and officials. "1'he artificial ice rink shall not be moved
<br /> irom the site of the injury until approvsl is graoted by Perfecl Parties, USA or the appropriate public safety o�cial. The only
<br /> exceptions to�this requirement are for fhe preservation of life and property, the removal of injured persons or bodies, or w permit the
<br /> Flow of traffic during an emergency: The artificial �ice rink and area s�urounding [he artificial ice rink shall not be dislurbed, deaned,.
<br /> or altereA in any way that wi11 impede any investigation involving an injury, crime or emergency.
<br /> ]0. Performers/ Shows: Cus[omer agrees thaz if ice skaters, perfortners or ice shows/performances are conhacted through Perfect
<br /> Pazries, USA, titat the qualiry of the show is noi debarable and refunds will not be given for subjective feedback.
<br /> 11. Cancellation Policy: 7Lis agreement cannot be cancelled except by written notification from the Customerreceived by Perfec[
<br /> Parties, USA at least thirly (30) days prior to the date of the event. In the event tha[ the Customer provides written notification to
<br /> Perfect Parlies, USA of cancellaiion as set forth above, the Customer agees to pay fifty percent (50%) of the en[ertainment fee (minus
<br /> any previously paid deposit). If the ageement is not cancelled in the manner set forth above, the Customer agees [o pay t6e entire
<br /> amount duo. �
<br /> Perfect Parties, USA offers no refund5 due W inclement weather or acts of god. The artificial ice rink can be used outdoors in snow
<br /> and rain; however, severe weather conditiovs to include hail, Gghtning or winds geater than 20 mph may �im�t and/or hinder use. In
<br /> this event, the C6stomer may be given a credit for futtire.date but this is at [he sole discre[ion of Perfec[ Parties, USA. Perfect Parties,
<br /> USA will make every effort to accommodate rescheduled date(s) but does not guarantee. Additional delivery and travel fees may
<br /> apply.
<br /> 12. Care of Fquipment sod Unsafe Conditions; The Customer agrees that they are fully responsible fo� [he care of the equipment or
<br /> property provided by� Perfect Parties, USA (M1ereafler koown as the "property") from the time of deli'very to [he time of pick up or ship
<br /> back. The Ctis[omer agets bo repvn al1 property to Perfect Parties, USA in good repa'v, Cundition, and working order, normal wear
<br /> and tear excepted. The Customer egrees that if tt�e property is not retumed in good repaii', condition, and working order, normal wear
<br /> and tear excepted, the Customer will cover the costs to renun the property to the condition it was in az the time of delivery. The
<br /> Customer fvrther agrees that Perfec[ Parties, USA is aiAharized to incur charges on the CustomePs credit card to cover said costs.
