4816.9.1.2 to ca2 for the spouse, domestic partner, child or parent of the employee who <br /> has a serious health condition; <br /> 3876.9.1.3 if the employee is unable to perform his/her job because of the employee's own <br /> serious health condition. <br /> For oumoses of this section the definition of: child means a bioloaical, adooted. or foster child. <br /> steochild. leaal ward, or a child of a oerson standina "in laro oarentis" (in the olace of a oarent. <br /> or a parenYs authoriN, who is under 18 vears of aqe or older and incaoable of seBcare because <br /> of inental or ohvsical disabilitv; spousldomestic oartner as defined or recoanized under state law: <br /> oarent is a bioloqical or adoptive oarent or a oerson who stood "in loco oarentis" to an emolovee <br /> when the emolovee was a child (parent-in-law does not aualitv). <br /> 4816.9.2 When an employee desires leave for the above stated reasons, the employee should give 30 <br /> calendar days written advance notice to hislher immediate supervisor (or if the event is <br /> unforeseeable employee should give as must notice as possible). <br /> The City may require that a request for family leave be supported by a certifcation issued by the <br /> employee's health care provider. <br /> Certification may also be required from the heafth care provider of ihe employee's child, parent <br /> or spouse who has a serious health condition before the employee is approved to use <br /> familylmediral leave to take care of that family member. <br /> Failure to compty with the above requirements may lead to denial of leave. <br /> a876.9.3 The employee may elect, or the City may require the employee, to substitute accrued vacation <br /> leave or other accrued time off during familylmedical leave. Sick leave may be used during the <br /> period ot familylmedical leave in accordance with the provisions of the Plan: <br /> 3816.9.4 The City will maintain contributions for the employee's health benefits under group health plans at <br /> the same level as prior to the leave, in accordance with the Family & Medical Leave Act. The <br /> employee may retum to the same position, or another position with equivalent benefits, pay and <br /> other terms and conditions of employment upon completion of the leave. <br /> �76.10 Court Appearonce Leave <br /> Leave for court appearance shall be granted by the City for court appearance on behalf of the City with no <br /> loss of salary. <br /> �76.11 Personal Business Leave <br /> 16.11.1 Personal Business is defined as business of urqent and comoellinq imoortance which cannot be <br /> taken care of outside of nortnal workinq hours and which is not covered under other leave <br /> orovisions of this Memorandum of Understandino. <br /> a816.11.�2 An employee shall be entitled to a maximum of two (2) days per year for Personal Business <br /> Leave for any reason without loss oi pay. Such leave shall be deducted from accrued sick leave. <br /> �16.11.�3 An employee must secure advance permission for all Personal Business Leave as defined <br /> above, and shall normally noGfy the de�a�raeat--peadFire Chief two (2) days before taking this <br /> 26 <br />
