<br /> THIS AGREEMENT, made and er�tered into fhis day of ,
<br /> 2011, by and between the CITY O� R��WOOD CITY, a charter city ar�d murticipal
<br /> corporafiion of the State of Caffarnia ("City"), and Kentfield Pacific Place, LLC,
<br /> a California Lim�ted E.iability Company ("Owner°).
<br /> WITN�SSETH:
<br /> WHEREAS, �wner is engaged in subdi�iding for residentiai purposes and
<br /> de�eloping cer�ain property under the designatior� of Final Map of Kenffield Pacific
<br /> Place, situated in �he City of Redwood City, Co�nty of San Mateo, State of California;
<br /> ar�d
<br /> WHEREAS, the City �ngineer has �etermi�ed that the fi�af map conforms to the
<br /> tentative map for the praposed subdivisian; an�
<br /> WHEREAS, Owner has requested that the final map be appro�ed prior to the
<br /> cor�s�ruetion and completion of the pubiic improvements, includir�g all public utility
<br /> facilities which are a part of, or appurtenant to, the a�ouem�ntiar�ed subdivision, which
<br /> improvements are to be constr�cted in accordance with, and as required by, the plans,
<br /> specifications and details hereinafter described;
<br /> NOW, THEREFORE, in order to ensure satisfactory perFormance by Owner of
<br /> Owner`s ohligations as required by fhe Cor�ditions of appro�al for the tentatiu� map for
<br /> said subdivision and by Chapfer 30 of the Code of the City of Redwood City, being the
<br /> s�bdivision reg�fations of said Gity, and in consideration of t�e appra�al af the final map
<br /> (including the dedication of easemer�ts contained therein) for the subdivision, and in
<br /> accordance with the conditions of approval of the tentati�� rr�ap for the s�rbdiuisior�, the
<br /> par#ies �ereto agree as follows:
<br /> 1. IMPROVEMENTS. Owr�er shalE, at Owner's own eost and expense,
<br /> furnish, eanstr�ct, install, comp[ete and guarantee all o� the impra�emer�ts
<br /> ("Impro�ements'), furnish all the materials, ar�d do all the work herei�after described, in
<br /> accordance with, and as pro�ided for in the plans prepared for Owner by MacL.eod &
<br /> Associates, lnc., Consulting Engir�eers and Surveyars, Sheets C-1 through G7 datetf
<br /> August 15, 2011, and in accordance wit� City's Specifications entitled, "Engineer�ng
<br /> Standards for the City af Redwoad City", adopted December 4, 200�, which plar�s and
<br /> specifications are on file in the office of the City Engineer. Said Irnpror�ements shall
<br /> aisa b� constructed in strict compliartce with the provisions of Chapter 30 of the Code af
<br /> the City of Redwood City, the subc{i�ision regulations af City. To the exfent that a
<br /> conflict exis#s between #he plans and specificatians and said Chapter 3Q in regard to the
<br /> s#andard for a particular impro�ement, the stricter standard shall govern. Owner shail
<br /> complete all af the fmpro�ements, subject fo tim� exfensions al[owable ur��er
