<br /> 8. WORK SUBJECT TO APPROVAL. All work provided for in this
<br /> Agreement ar�d mare speci�ica[ly described in t�e plans and specifications herein
<br /> referenc�d shafi be subject to the approval and acceptance by t�e Ci#y Engineer before
<br /> the �'elease of any security required herein. Reference is hereE�y made to {a) that
<br /> certain final map entitled, "Kentfield Pacific Place°, (b) those cerfiain plans or� fiEe in the
<br /> office af the City Engineer entitled "Kentfield Pacific Place, Sheets C-1 through C-7,
<br /> dated At�gust 15, 2011 °, and (c) those certain specifications entiti�d, "Engin��rir�g
<br /> Standards for #h� City Qf Redwood City", adopted December 4, 2006, for a more
<br /> partieular description of the work artd Improvements generaliy clescribed in this
<br /> Agreement. Said fina[ map, plans and specifications referenced ir� this paragraph are
<br /> h�reby incorporated herein and made a part of this Agreement. Upon completion of the
<br /> aforemerttioned work, a�d prior to the release of ar�y seeurity required her�in, Owner
<br /> shall fur�ish City with a complete set of plans and drawings showing t�e Impro�ements
<br /> in their aet�al or "as-builf" eondition and lacatior�.
<br /> 9. GUARANTEE OF WORKMANSHIP AND MATERIALS. Owner agrees
<br /> that if, withir� a period of ane (1) year after finai acceptar�ce of any work done �rtder this
<br /> Agreement, the improvements furnished andlar installed or canstructed or caused to be
<br /> co�str�cted by Owner, or any of the work don� under t�tis Agre�ment, fails ta fulfill any
<br /> of th� requirements of this Agreement, or the pEans and specifications referenced
<br /> hereir�, Owner sha[I upon receipt of a request in writing from City directing the work to
<br /> be done, wit}�ot�t delay and without any cost to City, repair or replace or reconstruct any
<br /> defecti�e ar otherwise unsatisfactory part or parts af the Impro�ements or work. Should
<br /> Owner fail to act promptly to make such repair, replacement or reconstruction, or
<br /> otherwise to act ir� accordance with this req�rirement �o repair, replace or reconstruct, or
<br /> should the exigencies of the cas� require that repair, replacement or reeonsfruetion be
<br /> made be�fore �wner can be notified, t�e City may, at its o�tion, make the r�ecessary
<br /> repair, replacement or reconstruction or perform the necessary work and �wner shall
<br /> pay the City the acfual east thereof plus fifteer� percent (15%).
<br /> Notwithstanding any pro�isions to the contrary as set forth in this Agreement,
<br /> Owner shal! not be respansible for repair, replacement, or reconstruction of any
<br /> Improvements, necessitated �y Acts of Go�, acts of fhird par�ies (other than Ovuner, its
<br /> agents, employees or contractors) beyond Owner's ability to cantrol, civil emergencies,
<br /> natural disasters, or similar acts or events.
<br /> 10. �EPQSIT F�R P�.AN CHECK AND lNSPECTION. Owner shall deposit
<br /> with City the sum of Twenty Three Thousand Nine Hu�dred �'ifty and 001100 Dollars
<br /> ($23,950.00) ("Deposit") to campensate City for all engir�eering, ins��ction, plan cheek,
<br /> laboratory and fie[d testing, constr�ction, and ather seEVices furnished by City in
<br /> cor�nection with the ]mprovemenfs for the said subdi�ision. Owner understands that the
<br /> Deposi� is an estimate and further agrees to pay to Cify the act�al cost of pro�idir�g such
<br /> servic�s, in accordance wit1� the City's current fees. Owner agrees to complete
<br /> payment of st�c� additionaE sum or sums for t�e se�vices pro�ided by City, if any, within
<br /> ten (10) days after billing by City of the adcfitional sum #o be paid and agrees that the
