aze focused on four distinct areas: (i) request for a densiry bonus; (ii) request for financially sufficient <br /> incentive(s) and/or concession(s); (iii) request for specific development sta�dard waivers; and (iii) <br /> request for the application of State pazking standazds. <br /> 11 Reauest for Densiri Bonus: <br /> In accordance with Section 65915(b)(1)(D) and (�(4), Owner has elected to provide seventeen (17) <br /> Affordable Units in exchange for an increase in density in acwrdance with Section 65915(�(4) of the <br /> Density Bonus Law. These 17 Affordable Units represent seventeen percent (17%) of the permitted <br /> number of residential units allowed under the City's NMSPP standard of forty-four (44) units per acre, <br /> or one hundred and one (101) units for the entire Project site. Pursuant to Section 65915(�(4), Owner <br /> is entided to a density bonus of Iwelve percent (12%), or an additional thirteen (13) units, over Ihe <br /> NMSSP's permitted density of 101 units. Owner hereby acknowledges and agrees that the 13 <br /> additional density bonus units described in this Section 2A1 fuliy satisfies Owner's right to a density <br /> bonus under [he Density Bonus Law. <br /> 2) Reouest for Incentives and/or Concessions <br /> In accordance with Section 65915(d)(2)(A), Owner has requested, and is entiNed to, financially <br /> sufficient incentive(s) and/or concession(s) in exchange for Owner's agreement to construct a common <br /> interest development as described in Section 65915(b)(1)(D). Owner proposes that the incentives <br /> andlor concessions be awazded in the following form: <br /> 1. One incentive in the form of eightee� (18) additional market-rate units to be included in the <br /> Project, thereby bringing the total number of residential dwelling units to be included in the <br /> Projec[ to one hundred and thirty-two (132) consisting of: <br /> a) ]Ol Units based on the permitted density under the NMSSP; <br /> b) 13 Units granted as a Density Bonus pursuant to GC 65915; and <br /> c) 18 Units granted as a financially sufficient incentive. <br /> 2. One concession in the form of a waiver of the requirements of Chapter 30, Article XI <br /> (Condominiums) of the City's Municipal Code, except as such provisions and requirements <br /> aze inw�porated into the Project as conditions of approval of the Ves[ing Tentative Map and <br /> Planned Community Permit, so that neither a Planned Development Permit nor a <br /> Condominium Permit shall be required for the Project. <br /> Owner acknowledges and agrees that the incentive and concessio� described above fully satisfies <br /> owners's right to financially su�cient incentives or concessions under the Density Bonus Law. <br /> 31 Development Standard Variance: <br /> In accordance with Section 65915(e), Owner has proposed the waiver of the foltowing Development <br /> Standazds which would otherwise apply to the Project under the NMSSP and other City land use and <br /> zoning regulations: <br /> a) Gazaee Hei�ht More than ]0' Above Adjacent Grade Elevation: Owner has requested a <br /> waiver of the applicable height restriction to allow for the garage deck height above adjacent <br /> grade to be slighdy more than ]0 feet.
