2 . Applicant shelf design all storm, sewer, and water facilities in <br />accord with Engineering Standards, Volume Ill, Design Criteria, and shall <br />submit all designs for prior review and approval of the City Engineer. <br />2. Applicant shall ensure that all Electrical/Telephone/TV Services <br />connection facilities are installed underground. <br />2. Applicant shall pay all applicable water and sever capital facilities <br />fees and installation fees, which will be determined by the City, based upon the <br />size and layout of the services to the project. <br />28. Applicant shall pay a Traffic Mitigation Fee based on the schedule <br />set by ordinance, or based on the Traffic Study, 'as determined by the City. <br />29. Applicant shall pay a Parrs Fee based on the schedule set by <br />Ordinance, as determined by the City. <br />30. Applicant shall provide for continuous site inspection by a Soils <br />Engineer to be approved by the City, at Applicant's sole expense, during <br />trenching and bard fill operations. The Soils Engineer shall take compaction <br />tests, and shall submit test results to the City's Engineering department for <br />approval. <br />31. Applicant shall continue to work with Carltr ns to obtain approval for <br />the applicant to install a new pedestrian crosswalk alb across El Camino Real near <br />the project site, and to relocate the Samtrans bus stop further north if Caltrarns <br />gives its approv <br />32. Applicant shall comply with all City, State and Federal regulations, <br />applicable to the Project. <br />33. there a Planned Development PD Permit has not been used <br />within one 1 year from the dame of granting, either by beginning of construction <br />of the improvements or by the initiation of the activity which is the subject of the <br />PD Permit, said Permit shall automatically terminate and be of no further effect. <br />34, Pursuant to Section 66474.9(b) of the California Government Code, <br />Applicant shall defend, indemnify, and hold harmless the City, its agents, officers, <br />and employees from any claim, action, or proceeding against the City or its <br />agents, officers or employees, to attack, set aside, gold, or annul an approval of <br />the City, including but not limited to the Planning Commission, and the City's and <br />Planning Commission's agents, officers or em ployees, concerning this <br />subdivision, brought within the time period provided for in Section 66499.37. <br />The City shard promptly notify Applicant of any such claim, action or proceeding <br />and shall cooperate fully in the defense. <br />ATTY/ E , 1801ATTA HMEI T -PD GUEST PARKING RESO-MELS 2580 ECR <br />fEV:1107l11 <br />Page 7 of <br />
