2g. Applicant shall pay a Parks Fee based on the schedule set by Ordinance, as <br />determined by the City. <br />30.Applicant shall provide for continuous site inspection by a Soils Engineer to <br />be approved by the City, at Applicant's sole expense, during trenching and <br />backfill operations. The Soils Engineer shall take compaction tests, and shall <br />submit test results to the City's Engineering department for a pproval. <br />31.Applicant shall continue to work with Caltrans to obtain approval for the <br />applicant to install a new pedestrian crosswal across El Camino Real rear <br />the project site, and to relocate the Sarntrans bus stop further north if Caltrans <br />gives its approval. <br />32. Applicant shall comply with all Cities, state and federal regulations, applicable <br />to the Project. Where a Planned Development P Permit has not been used <br />within one 1 year from the date of granting, either by beginning of <br />construction of the improvements ent or by the initiation of the activity which is the <br />subject of the PD Permit, said Permit shall automatically terminate and be of <br />no further effect. <br />33. Pursuant to Section 66474.9(b) of the California Government Code, Applicant <br />shall defend, indemnify, and hold harmless the City, its agents, officers, and <br />employees from any claim, action, or proceeding against the City or its <br />agents, officers or employees, to attack, set aside, void, or annul an approval <br />of the City, including but not limited to the Planning Commission, and the <br />City's and Planning Commission's agents, officers or employees, concerning <br />this subdivision, brought within the time period provided for in Section <br />66499.37.
