California Department of Public Health - Special Terms and Conditions Exhibit D(F) <br /> 29. Union Organizing <br /> (Applicable only to grant agreements.) <br /> Grantee, by signing this Agreement, hereby acknowledges the applicability of Government Code Sections <br /> 16645 through 16649 to this Agreement. Furthermore, Grantee, by signing this Agreement, hereby certifies <br /> that: <br /> a. No state funds disbursed by this grant will be used to assist, promote or deter union organizing. <br /> b. Grantee shall account for state f�nds disbursed for a speciflc expenditure by this grant, to show those <br /> funds were allocated to that expenditure. <br /> c. Grantee shall, where state funds are not designated as described in b herein, allocate, on a pro-rata basis, <br /> all disbursements that support the grant program. <br /> d. if Grantee makes expendi".ures tc assist, promote or deter union organizing, Grantee will maintain records <br /> sufficient to show that na state funds were used for those expenditures, and that Grantee shall provide <br /> those records to the Attorney General upon request. <br /> 30. Contract Uniformity (Fringe Benefiit Allowability) <br /> (Appiicable only to nonprofit organizations.) <br /> Pursuant to the provisions of Article 7(commencing with Section 100525) of Chapter 3 of Part 1 of Division <br /> ' 101 of the Health and Safety Code, CDPH sets forth the following policies, procedures, and guidelines <br /> regarding the reimbursement oi fringe benef,s. <br /> � a. As used herein fringe b�nefi,s si�all mean ar. employr.�ent benefit given by one's emGlo�er to an employee <br /> ' in aaditio�i to one's �egular or r.orrnal wages p; saiary. <br /> b. ks use7 herein, fringe benef�s do noi includa: <br /> ' - (1) Compensation for personal senices paid r.urrently or accrued by the Contractor for services of <br /> � ' employees rendered duri�;q tha tern�� of this .Agreemer,t, which is identified as regular or normal <br /> � salaries and wages, ar�ival leave, vacation, sick leave, holidays, jury duty and/or military <br /> leaveftrai�ing. <br /> (2) Director's and executive comminee member's fees. <br /> (3) Incentive awards and/or bonus incentive pay. <br /> (4) Altowances for ofP-sitc pay. <br /> (5) Location ahowances. <br /> (6) Hardship pay. <br /> (7) Cost-of-living differentiaU <br /> c. Specific allowable iringe benefits inc{ude. <br /> (1) Fringe benefits in the forrn of emplcyer cantributions for the employer's portion of payroll taxes (i.e., <br /> FICA, SU�, SQI), employee healtn plans (i.e., health, dental and vision), unemployment insurance, <br /> worker's compersation ir;urance, and the empluyer's share of pensioNretirement plans, provided <br /> they are granted in accordance with established written organization policies and meet all iegal and <br /> Internai Ravenue Service reGuirements. <br /> d. To be an allowable fringe benefit, the cost must meet the following criteria: <br /> (1) Be necessary and reasonable for the performance of the Agreement. <br /> (2) Be determined in accordance with generally accepted accounting principles. <br /> (3) Be consistent with policies that apply uniformly to all activities of the Contractoc <br /> e.
