adequate and appropriate evidentiary basis for the findings and actions set forth <br />in this Resolution. <br />Section 3. Planned Community DPC20I1- : The Planning Commission <br />finds that: <br />a. The project and improvements proposed by Planned <br />Community Permit Application No. DPC201 -o2 are <br />consistent with, conform to the intent of, and will <br />appropriately implement the Do wntown Precise Plan for the <br />201 Marshall Street Residential Project; and <br />b. The establishment, maintenance and operation of the project <br />and improvements proposed by Planned Community Permit <br />No. PC2011 -02 will not, under the circumstances of this <br />particular case, be detrimental to the health, safety peace, <br />morals, or general welfare of persons residing or working in <br />the neighborhood of the project, or be detrimental or <br />injurious to property or improvements in the neighborhood of <br />the project, or to the general welfare of the City, because the <br />project has been found to be consistent with the community <br />goals established in the City's General Plan and Zoning <br />Ordinance. <br />Section 4. The Planned Community Permit is hereby conditionally granted <br />based on the Planning Commission's consideration and reliance on the Initial <br />Study IS and in accordance with the plans, details and descriptions contained <br />therein, attached hereto and incorporated herein by reference and the following <br />Conditions of Approval: <br />CONDITIONS F APPROVAL: <br />1. Applicant shall implement and comply with all applicable mitigation <br />measures described in the Environmental Impact Report EIF and Mitigation, <br />Monitoring Program MMF P for the Downtown Precise Plan, adopted by the City <br />Council by resolution No. 15086 and on file with Planning Services (State <br />Clearinghouse #2006052027). <br />2. Applicant shall insure that all improvements substantially conform <br />to the project plans, prepared by Thomas P. Cox ,Architects Inc, submitted on <br />November 10, 2011, and related information submitted by Applicant, on file with <br />Planning Services. <br />3. All modifications to said approved plans must be submitted to <br />Planning for refer and approval prior to the issuance of a Building Permit. <br />Substantial modification of said approved plans, as determined by the <br />ATT / E .21881201 MARSHAL P <br />REV* 12/29/11 <br />Page 2 of <br />
