01 /23/2012 ORIGINAL ORDINANCE NO. 1130-356 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AMENDING ARTICLE 48 OF THE REDWOOD CITY ZONING CODE RELATING TO APPEALS WHEREAS, the purpose of this amendment is to update appeals procedures and to adopt uniform appeal procedures. NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. Article 48 of the Redwood City Zoning Code is hereby amended to read as follows: ARTICLE 48 APPEALS 48.1 Finality of Decision — Appeal Stays Action A decision on a discretionary approval is not final until the time for appeal expires as an appeal shall stay all actions and rights on the matter being appealed unless it is determined and certified by the original decision maker that a stay would cause imminent peril to life and property. 48.2 Time for Appeal All appeals must be filed within fifteen days of the date of the notice of the decision or determination being appealed. Appeals may not be processed on actions which must be heard by and receive final action by the City Council. 48.3 Right of Appeal. A. Any person aggrieved by a final determination of the Zoning Administrator, the Planning Manager or the Community Development Director pursuant to this Zoning Code, may appeal such determination to the Planning Commission, whose decision on such appeal shall be final. Any person aggrieved by a final decision of the Planning Commission may appeal such action to the City Council. Provided, however, no appeal may be had from decisions of the Planning Commission on matters appealed to the Planning Commission. B. Any two Councilmembers may request City Council review of any final determination of the Planning Commission, the Zoning Administrator or the Community Development Director, by filing a written request with ATTY/ORD.357/AMENDING ARTICLE 48 OF THE RWC ZONING CODE ORD. # 1130356 REV:12/13/11 FORMERLY MUFF # 305 1
