01 /23/2012 <br /> ORIGINAL <br /> ORDINANCE NO. 1130-356 <br /> ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY AMENDING ARTICLE 48 OF THE REDWOOD <br /> CITY ZONING CODE RELATING TO APPEALS <br /> WHEREAS, the purpose of this amendment is to update appeals <br /> procedures and to adopt uniform appeal procedures. <br /> NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> DOES ORDAIN AS FOLLOWS: <br /> Section 1. Article 48 of the Redwood City Zoning Code is hereby <br /> amended to read as follows: <br /> ARTICLE 48 APPEALS <br /> 48.1 Finality of Decision — Appeal Stays Action <br /> A decision on a discretionary approval is not final until the time for appeal <br /> expires as an appeal shall stay all actions and rights on the matter being <br /> appealed unless it is determined and certified by the original decision maker that <br /> a stay would cause imminent peril to life and property. <br /> 48.2 Time for Appeal <br /> All appeals must be filed within fifteen days of the date of the notice of the <br /> decision or determination being appealed. Appeals may not be processed on <br /> actions which must be heard by and receive final action by the City Council. <br /> 48.3 Right of Appeal. <br /> A. Any person aggrieved by a final determination of the Zoning <br /> Administrator, the Planning Manager or the Community Development <br /> Director pursuant to this Zoning Code, may appeal such determination <br /> to the Planning Commission, whose decision on such appeal shall be <br /> final. Any person aggrieved by a final decision of the Planning <br /> Commission may appeal such action to the City Council. Provided, <br /> however, no appeal may be had from decisions of the Planning <br /> Commission on matters appealed to the Planning Commission. <br /> B. Any two Councilmembers may request City Council review of any final <br /> determination of the Planning Commission, the Zoning Administrator or <br /> the Community Development Director, by filing a written request with <br /> ATTY/ORD.357/AMENDING ARTICLE 48 OF THE RWC ZONING CODE ORD. # 1130356 <br /> REV:12/13/11 FORMERLY MUFF # 305 <br /> 1 <br />
