Code § 27383. <br />LANDSCAPE MAINTENANCE AGREEMENT <br />THIS LANPSCAPE MAINTENANCE AGREEMENT ( "Agreement ") is made and entered into <br />this ay of , 20A ( "Effective Date "), by and between RC PENINSULA PARK, <br />LLC, a Delawar11i liability company ( "Developer "), and the CITY OF REDWOOD CITY, a <br />charter city and California municipal corporation ( "City ") with reference to the following facts: <br />RECITALS <br />A. Reference is made to that certain real property situated in the City of Redwood City, County of San <br />Mateo, State of California, known as the One Marina site, consisting of Assessor's Parcels 052 -531- <br />130, 052 - 531 -140, 052- 531 -150 and 052 -531 -160, as shown and on Exhibit "A" attached hereto and <br />incorporated by this reference as if fully set forth herein ( "One Marina "). One Marina is being <br />developed as a condominium project. The Developer expects to transfer its interest in One Marina to <br />One Marina Owners Association ( "HOA "), a California nonprofit mutual benefit corporation, which <br />HOA shall be ultimately responsible for the management, operation and governance of the One <br />Marina condominium project, and which HOA shall ultimately be responsible for maintenance of the <br />Improvements and the Maintenance Standards, Maintenance Services and related obligations <br />described herein this Agreement. <br />B. In connection with its development of One Marina as a residential community, the Developer <br />submitted to the City a Precise Plan, PC Permit and Construction Plans, which include, inter alia, <br />landscaping plans for reconstructed Bair Island Road along the One Marina frontage ( "Plans "), all of <br />which Plans have been approved by the City. The Plans provide for installation of certain <br />landscaping, pedestrian lighting, irrigation piping and controller, pedestrian path, bicycle path, and <br />bioswales ( "Improvements ") within that portion of the City owned public utility easement beginning <br />at the back of the south Bair Island Road curb and extending south from there to the south side of the <br />pedestrian path /sidewalk along the entire One Marina site frontage along Bair Island Road and within <br />the circular planting area in the Bair Island round about ( "Maintenance Area ") as the Improvements <br />and Maintenance Area are more specifically shown on Exhibit "B" attached hereto and by this <br />reference made a part hereof. <br />C. The Developer has submitted a final snap for One Marina, which has been reviewed by the City <br />Engineer and is being approved concurrently with this Agreement ( "Final Map "). <br />D.
