6.5.A. - Page 4 <br />ORDINANCE NO. <br />ORDINANCE OF THE CITY <br />REDWOOD CITY AMENDING <br />REDWOOD CITY MUNICIPAL <br />RULES AND WATERFOWL <br />COUNCIL OF THE CITY OF <br />SECTION 25.2.02 (1) OF THE <br />CODE RELATING TO PARK <br />WHEREAS, Section 25.2.02(1) of the Redwood City Municipal Code generally <br />prohibits harassing waterfowl in City Parks; and <br />WHEREAS, a rapid increase in the local number of non - migratory Canada geese <br />and the excrement they leave in open spaces in the Redwood Shores area, including <br />parks and trails, is negatively affecting the community's ability to enjoy these open <br />spaces; and <br />WHEREAS, the United States Fish & Wildlife Service and the California <br />Department of Fish and Game have the authority to regulate depredation of various fowl <br />including Canada geese in Redwood City; and <br />WHEREAS, the Redwood City Municipal Code should be amended to more <br />explicitly recognize federal and state regulatory and permitting authority over <br />depredation of fowl. <br />NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES <br />ORDAIN AS FOLLOWS: <br />Section 1. Section 25.2.02 of the Redwood City Municipal Code is hereby <br />amended by adding the text shown in bold italics (example): <br />Sec. 25.2.02. Prohibited Acts. No person shall engage in the following <br />prohibited acts and /or uses in a City park or facility: <br />[Subsections A through H, and Subsections J through N, remain unchanged.] <br />Feed, capture, remove, hunt, abuse, molest, injure, frighten, trap, kill, <br />tease or hurt, throw or otherwise project objects at any wild or domestic <br />fowl, animal, reptile, fish or bird or fowl, including the eggs or nest or <br />young of any reptile, wild animal, or bird, except in conformance with <br />federal or state regulations and/or permits; <br />ATTY /ORD.368 /AMENDING SECTION 25.2.02 /PARK RULES AND WATERFOWL <br />REV: 01/31/12 Page 1 of2 <br />
