It is mandatory that all teams who intend to submit a bid, fully
complete the pre-qualification questionnaire, provide all materials requested in the RFQ, and be
approved by the Port of Redwood City to be on the final qualified Bidders list. No bid will be
accepted from a team that has failed to comply with these requirements. The necessary
components of the "team" include a general contractor, engineer of record, and necessary
subcontractors to perform the services required. This "team" is referred to as the "Contractor" in
tlus RFQ.
Answers to questions contained in the attached questionnaire, informarion about current bond'utg
capacity, notarized statement from surety, and the most recent reviewed or audited financial
statements, with accompanying notes and supplemental informarion, aze required. The Port of
Redwood City will use these documents as the basis of rating Contractors to determine their
qualificarion to bid projects the size of the Wharves 1 and 2 Pmject. The Port reserves the right to
check other soutces available. The Port's decision will be based on objective evaluation criteria.
The Port reserves the right to adjust, increase, limit, suspend or rescind the pre-qualificadon
rating based on subsequenfly leazned information. Teams whose rating changes sufficient to
disqualify thecn will be notified, and given an opportunity for a hearing consistent with the
hearing procedures described below for appealing a pre-qualificarion rating.
While it is the intent of the pre-qualification quesrionnaire and documents required therewith to
assist the Port of Redwood City in determining bidder responsibility prior to bid and to aid in
selecting the lowest responsible bidder, neither the fact of pre-qualification, nor any pre-
qualificarion rating, will preclude the Port from a post-bid consideration and determination of
whether a bidder has the quality, fitness, capacity and experience to saNsfactorily perform the
proposed work, and has demonstrated the requisite trustworthiness.
The pre-qualification packages submitted by the Contractor aze not public records and aze not
open to public inspection. All information provided will be kept confidential to the extent
peimitted by law. However, the contents may be disclosed to third parties for purpose of
verification, or investigation of substantial allegations, or in the appeal hearing. State law requires
that the names of teams applying for pre-qualification status shall be public records subject to
disclosure, and Appendix C of this RFQ will be used for that purpose. Each prequalification
package must be signed under penalty of perjury in the manner designated in Appendix D, by an
individual who has the legal authority to bind the Contractor on whose behalf that person is
signing.
