C�0 G°�� <br /> The Port of Redwood City reserves the right to waive minor irregularities and omissions in the <br /> information contained in the pre-qualification application submitted, to make all final <br /> determinations, and to determine at any time that the pre-qualification procedures will not be <br /> applied to the Wharves 1 and 2 Project. <br /> Pre-qualifications aze due to be received by Port of Redwood City, at 675 Seaport Blvd., <br /> Redwood City, CA, 94063 by 5:00 PM PDT, Mazch 16, 2012. Contractors may submit pre- <br /> qualification packages during regular working hours on any day that the offices of the Port of <br /> Redwood City are open. <br /> The Port of Redwood City may refuse to grant pre-qualification where the requested information <br /> and materials aze not provided, or not pmvided by Mazch 16, 2012. There is no appeal from a <br /> refusal for an incomplete or late applicarion. The closing time for bids will not be changed in <br /> order to accommodate supplementarion of incomplete submissions, or late submissions. <br /> Where a timely and completed applicarion results in a rating below that necessary to pre-qualify, <br /> an appeal can be made. An appeal is begun by the Contractor delivering notice to the Port of <br /> Redwood City of its appeal of the decision with respect to its pre-qualification rating, within five <br /> (5) calendaz days of the date of mailing or delivery (personally or via facsimile) of the Port's <br /> rating determination. Without a rimely appeal, the Contractor waives any and all rights to <br /> challenge the decision of the Port of Redwood City, whether by administrative process, judicial <br /> process or any other legal process or proceeding. <br /> The Port will provide the appellant a Notification of the basis for the disqualification and any <br /> supporting evidence that has been received from others or adduced as a result of an investigarion <br /> by the Port. The Norification will state the Appellant will have the oppommity to be heard before <br /> the Appeals Panel (delegated by the Port of Redwood City Board of Commissioners) within three <br /> (3) calendaz days from the date of delivery or mailing of the Notification. The Contractor will be <br /> given the opportunity to present information and present reasons in opposition to the rating. <br /> Within one day after the conclusion of the hearing, the Appeals Panel will render its decision. It <br /> is the intention of Port of Redwood City that the date for the submission and opening of bids will <br /> not be delayed or postponed to allow for completion of an appeal process. <br /> Note: A Contractor may be found not pre-qualified for bidding on The Wharves 1 <br /> and 2 Replacement Project contract to be let by the Port of Redwood City. In <br /> addition, a Contractor may be found not pre-qualified for either: <br /> (1) Omission of requested information or <br /> (2) Falsification of information <br /> The Port of Redwood City shall have no obligarion to any Respondent to tlris RFQ unless and until <br /> the Port awards a contract. The Port reserves the right to reject any or all responses to this RFQ and <br /> subsequent bids for any reason or no reason. There is no guazantee the Port will issue any notice to <br /> proceed and the Port may terminate at any time any agreement, pursuant to the termination clause in <br /> the agreement, entered into as a result of ttris procurement process. <br /> paqe a a a <br /> �y, <br /> � l/ <br />
