Exclusive Use Common Areas: The following described portions of the <br />Common Area, referred to as "Exclusive Use Common Areas," are set aside and allocated for the <br />exclusive use of the Owner of the Condominium to which they are attached or assigned as shown <br />on the Condominium Plan or in Exhibit "A" or otherwise provided in the grant deed from the <br />Declarant conveying the Unit to an Owner, and are appurtenant to that Condominium: <br />(1) The Parking Space or Parking Spaces designated "P" (followed by a <br />number) on the Condominium Plan that are allocated and assigned to the Unit in the grant deed <br />from the Declarant to the original purchaser of the Unit from the Declarant, with the express <br />requirement that any tandem parking spaces shall be assigned to the same Unit Owner and Unit; <br />and the parking space assignments shall be as set forth in Exhibit "A" attached hereto. <br />(2) a Patio designated "PT ", followed by the number of the Unit; and /or <br />(3) a Balcony designated "B ", followed by the number of the Unit; and/or <br />(4) The Storage Space designated "S" (followed by a number) on the <br />Condominium Plan that are allocated and assigned to the Unit in the grant deed from the Declarant <br />to the original purchaser of the Unit from the Declarant; <br />In addition, the following areas or items are "Exclusive Use Common Areas" appurtenant to <br />the Condominiums in which they are located or attached: <br />(1) The airspace above the Unit as shown on the Condominium Plan, and the inside face <br />of the structural roof framing; <br />(2) that portion of any Common Area floor or ceiling that is pierced by interior stairs; <br />(3) the space between the exterior boundary of any Unit and the interior surface of any <br />bay window or greenhouse window; <br />The air conditioning equipment serving a Unit is part of the Unit, belongs to the Owner of that <br />Unit, and shall be maintained by the Owner. The space occupied by the airconditioning equipment, <br />wherever located, shall be restricted to the exclusive use of the Owner whose air conditioner <br />occupies such space. <br />Except as described herein, no other portion of the Common Areas shall be Exclusive Use <br />Common Area. <br />D. Reserved Rights of Declarant and Board over Common Areas: The <br />Board or Declarant (as long as Declarant owns twenty -five percent (25 %) or more of the <br />Condominiums in the Project shall have the power and the right in the name of the Association and <br />all of the Owners as their attorney -in -fact to grant, convey or otherwise transfer to any Owner or any <br />other Person fee title, easements, leasehold estates, exclusive use easements or rights, licenses, <br />lot -line adjustments, rights -of -way and /or dedications in, on, over or under the Common Area or <br />other property interests in order to: (i) construct, erect, operate, maintain or replace lines, cables, <br />wires, conduits or other devices for electricity, cable television, Internet services, fiber optics, <br />telecommunication equipment, power, telephone and other purposes, public sewers, storm water <br />drains and pipes, water systems, sprinkling systems, water, heating and gas lines or pipes and any <br />similar public or quasi - public improvements orfacilities; (ii) accommodate any encroachment that in <br />the sole discretion of the Board or Declarant does not unreasonably interfere with the use and <br />enjoyment of the Common Area; or (iii) accomplish any other purpose that in the sole discretion of <br />the Board or Declarant is in the interest of the Association and its Members and does not <br />unreasonably interfere with the use enjoyment of the Common Area.
