B. - Page 53 <br />Condominiums in the Project) as attorney -in -fact of such Owner to execute and deliver all <br />documents and interests to accomplish the action, including, but not limited to, grant deeds, <br />easements, subdivision maps, and lot -line adjustments. Notwithstanding anything herein to the <br />contrary, in no event shall the Board or Declarant take any action authorized hereunder that would <br />permanently and unreasonably interfere with the use, occupancy and enjoyment by any Owner of <br />his or her Condominium or any Exclusive Use Common Area without the priorwritten consent of that <br />Owner. Furthermore, the conveyance of fee title to any portion of the Common Area as authorized <br />in this Section 2.2.D (other than conveyances made as a part of lot -line adjustments) shall require <br />the consent of a majority of the total voting power of the Association other than Declarant and such <br />consent of the Mortgagees as may be required by Section 10.6. <br />2.3. Parking: Declarant reserves the right to grant Parking Spaces as Exclusive Use <br />Common Areas to each of the Units in the Project as provided in this Declaration. All Parking <br />Spaces are to be assigned by Declarant as Exclusive Use Common Area to particular Units at the <br />time of the first conveyance of each Unit by Declarant to an Owner. <br />A. There are handicapped person's parking spaces in the Project that is <br />designated as such on the Condominium Plan. The Declarant will assign these handicapped <br />person's Parking Spaces to a Condominium as an Exclusive Use Common Area parking space. If <br />the Occupants of the Condominium assigned a handicap space are not appropriately licensed to <br />use a handicap parking space by the State of California and the Occupant of another Condominium <br />assigned a parking space is appropriately licensed and the space assigned this Condominium for <br />such Occupant is not a handicap parking space (the "Licensed Occupant "), the Association, on <br />receipt of written request from the Licensed Occupant, shall require the Owner of the Condominium <br />that has been assigned a handicap space that is not used by a Licensed Occupant to exchange the <br />handicap space with the space assigned to the Condominium occupied by the Licensed Occupant. <br />The exchange shall remain in effect as long as the Licensed Occupant occupies the Condominium <br />and remains licensed to use a handicap space and shall terminate automatically on the date the <br />Licensed Occupant ceases to occupy the Condominium or ceases to be appropriately licensed to <br />use a handicap parking space, whichever occurs first. The exchange shall be temporary and shall <br />not alter the permanent parking space(s) assigned to any Condominium and appurtenant to the <br />Condominium. The Owner of the Condominiums assigned the handicap spaces covenant to <br />cooperate with the Association and any Licensed Occupant in effecting any exchange required <br />under this Section 2.3. The right to exchange a non - handicap space for a handicap space <br />hereunder shall be available to any Licensed Occupant on a first -come, first -serve basis as to the <br />Parking Space that has been designated for such use. The Association shall have no obligation to <br />create or establish any additional such handicap parking spaces. The Board may adopt Rules <br />regulating the exchange of a non - handicap space for the handicap space that are not inconsistent <br />with the provisions of this Section 2.3. If the Person requesting use of a handicap parking space is <br />the holder or user of a tandem Parking Space, then the exchange of the Parking Space shall include <br />the entire tandem space. <br />B. No parking space may be rented, licensed or transferred for use by anyone <br />other than an Owner of a Condominium in the Project. A Condominium Owner may enter into an <br />agreement with the Owner of another Condominium forthe temporary use of a space by the Owner <br />or Occupant of the other Unit. The agreement shall be a license only and shall not transfer any <br />other interest in the space.
