6. 1. B. - Page 68 <br />regulations by third parties (including Owners and Occupants) who use the Common Area. The <br />Board shall, when it becomes aware of any violation of the aforementioned laws, regulations, <br />statutes and ordinances, expeditiously undertake to correct such violations. <br />C. Insurance: The Association shall maintain such policy or policies of <br />insurance as are required by Section 8.1 of this Declaration. <br />D. Discharge of Liens: The Association shall discharge by payment, if <br />necessary, any lien against the Common Area, and charge the cost thereof to the Owner or Owners <br />responsible for the existence of the lien (after notice and a hearing, as provided in the Bylaws). <br />E. Assessments: The Association shall fix, levy, collect and enforce <br />Assessments as set forth in Article IV hereof. <br />F. Payment of Expenses and Taxes: The Association shall pay all expenses <br />and obligations incurred by the Association in the conduct of its business including, without <br />limitation, all licenses, taxes or governmental charges levied or imposed against the property of the <br />Association. <br />G. Enforcement: The Association and the Board shall be responsible for the <br />enforcement of this Declaration. <br />5.2. Powers: In addition to the powers enumerated in the Articles and Bylaws or <br />elsewhere provided for in this Declaration, and without limiting their generality, the Association, and <br />the Board, where applicable, shall have the following powers: <br />A. Utility Service: The Association shall have the authority to obtain utility <br />services for the Common Area. The costs for such utility services shall be included by the <br />Association as part of the Association's Common Expenses to be included as part of the <br />Association's Regular Assessments. The cost for Common Area water for irrigation and fire <br />protection shall be allocated equally among the Condominiums. The Association may also obtain for <br />the Owners and Occupants of the Units cable television service and other communications services. <br />The Association shall obtain garbage and trash collection services for the Project as part of the <br />Common Expenses. Water and electricity shall be metered separately to each Unit. <br />B. Easements: The Association shall have authority, by document signed by <br />the President and the Secretary, to grant permits, licenses, and easements in addition to those <br />shown on the Map or Condominium Plan and/or referred to in Article VI, where necessary for roads, <br />utilities, communications services, cable television, and sewer facilities over the Common Area to <br />serve the common and open space areas and the Condominiums, and /orwhere necessary to satisfy <br />or achieve appropriate governmental purpose or request. The Board of Directors may grant <br />exclusive use easement rights over a portion of the Common Area to a Member with the affirmative <br />vote of sixty -seven percent (67 %) of the separate interests in the Project, and without the approval <br />of the Members in those limited cases set forth in California Civil Code § 1363.07. <br />C. Manager: The Association may employ a professional management firm and <br />contract with independent contractors or managing agents to perform all or any part of the duties <br />and responsibilities of the Association, including maintenance operations and waste /recycling <br />collection procedures, except for the responsibility to levy fines, impose discipline, hold hearings, file <br />suit, record or foreclose liens, or make capital expenditures, provided that any contract with a firm or <br />person appointed as a manager or managing agent shall not exceed a one (1) year term, shall <br />24 <br />03/06/12 <br />T:IWPWIN601PR0]ECTS1333 MAIN STREETIDEC - DRAFTING FORM[71[03 06 12].doc <br />
