B. - Page 67 <br />reimburse the Association for its repair cost to the extent the cost is not paid through insurance <br />maintained by the Association, and the Association may levy a Reimbursement Charge to recover <br />the cost. If the damage may be covered by insurance maintained by the Association, the <br />Association shall submit an appropriate claim. Any deductible amount shall be paid by the <br />Responsible Owner. If a Unit Owner becomes aware of any potential problems or issues with <br />respect to the Common Area improvements, including, but not limited to, those listed in this Section <br />5.1.A, and particularly any water leaks or potential water leaks, the Owner shall promptly notify the <br />Board of the Project's manager regarding such problems or issues with respect to the Common <br />Area improvements. <br />B. Inspection and Maintenance Guidelines; Homeowners Association <br />Handbook: The Declarant shall provide the Association with a Homeowners Association <br />Handbook, and each Owner with a Homeowners Care Manual for the inspection and maintenance <br />of the improvements within the Project. The Board shall comply with the Homeowners Association <br />Handbook for the periodic inspection and maintenance of the Common Area improvements and <br />landscaping that the Association is required to maintain under this Declaration, and any other <br />improvements outside of the Common Area, which the Association has the responsibility to <br />maintain, including, without limitation, the maintenance requirements provided for in Section <br />5.1.A(2). The Board shall take all appropriate actions to implement and comply with the <br />Homeowners Association Handbook. <br />(1) The Board shall cause professional inspections of Major Components <br />and of all Common Area infrastructure to be routinely made. The Board shall engage professionals <br />to conduct such inspection if the Board or the Association's manager deems that such inspections <br />by professionals, such as an architect, a civil engineer and a landscape architect, or other such <br />professional, is warranted. Inspections shall be made at least yearly, and for appropriate items or <br />events, more often. Inspections will include a review of all repair records since the previous <br />inspection. The Board shall cause a log ( "Maintenance Log ") to be kept to record all inspection and <br />maintenance performed, and to record who performed the work, the results, and the date the <br />inspection or maintenance was performed. <br />(2) The Board shall annually report to the Members the results of the <br />inspection, and the status of maintenance of the Common Area, and shall include a copy of the <br />Maintenance Log. The reports shall address any noted deterioration which may require future <br />attention. The reports may also recommend supplemental specialized investigations (i.e., elevator, <br />termite, pool, mechanical, arborist, limnologist, geologist, structural, etc). <br />(3) The Association shall keep permanent records of all: (a) Complaints and <br />potential problems, including description, date and bywhom; (b) Reports, including inspections and <br />recommendations; (c) Maintenance and repairs, including description, location, date, bywhom made <br />and cost; and (d) Plans, including construction drawings, subsequent modifications, and repair <br />plans. <br />(4) The Board may, from time to time, make appropriate revisions to the <br />Homeowners Association Handbook based on the Board's review thereof, to update such handbook <br />to provide for inspection and maintenance according to current industry practices so long as such <br />changes do not reduce the useful life or functionality of the items being maintained. <br />(5) The Board shall undertake to cause inspection, maintenance and <br />operation of the Common Area of the Project in accordance with all applicable municipal, state, and <br />federal laws, regulations, statutes and ordinances.
