<br />pay all charges for utilities supplied to the Project except those metered or charged separately to the
<br />Condominiums. Water and electricity shall be metered separately to each Unit.
<br />ARTICLE VII. USE RESTRICTIONS
<br />In addition to all of the covenants contained in this Declaration, the use of the Project and
<br />each Condominium in the Project is subject to the following:
<br />7.1. Condominium Use: No Condominium shall be occupied and used except for
<br />residential purposes by the Owners or Occupants, and no trade or business shall be conducted in
<br />any Condominium, except that residential Condominiums may be used as a combined residence
<br />and executive or professional office by the Owner or Occupant thereof, so long as such use: (a)
<br />does not interfere with the quiet enjoyment by other Owners; (b) does not include visiting clients; (c)
<br />business activities take place solely inside the Unit; (d) does not generate in- person visits by
<br />suppliers or clientele; (e) complies with all laws, regulations and ordinances applicable to the
<br />Property, including zoning, health and licensing requirements; (f) otherwise complies with the
<br />Declaration and is consistent with the residential character of the Property; (g) no signs, logos,
<br />billboards, or other advertising materials or devices are displayed in the windows of the Unit, or on
<br />exterior of a Unit, or on any Common Area, to advertise the activity; (h) the existence oroperation of
<br />the business is not apparent or detectable outside the Unit by sight, sound or odor; and (i) the
<br />business does not increase the liability or casualty insurance obligation or premium of the
<br />Association. Declarant, its successors or assigns, may use any Condominium or Condominiums in
<br />the Project owned by Declarant for a model home site or sites and display and sales /construction
<br />office during construction and until the last Condominium is sold by Declarant, or until three (3) years
<br />from the date of closing of the first sale in the Project, whichever occurs first. No tent, shack, trailer,
<br />basement, garage, outbuilding or structure of a temporary character shall be erected or used at any
<br />time as a residence, either temporarily or permanently.
<br />A. No Condominium or any portion of any Condominium in the Project shall be
<br />leased, subleased, occupied, rented, let, sublet, or used for or in connection with any time sharing
<br />agreement, plan, program or arrangement, including, without limitation, any so- called "vacation
<br />license," "travel club," "extended vacation," or other membership or time interval ownership
<br />arrangement. The term "time sharing" as used herein shall be deemed to include, but shall not be
<br />limited to, any agreement, plan, program, or arrangement under which the right to use, occupy, or
<br />possess the Condominiums or any portion of the Condominiums in the Project rotates among
<br />various persons, either corporate, partnership, individual, or otherwise, on a periodically recurring
<br />basis for value exchanged, whether monetary or like kind use privileges, according to a fixed or
<br />floating interval or period of time of twenty -five (25) consecutive calendar days or less. This Section
<br />shall not be construed to limit the personal use of any Condominium or any portion of the
<br />Condominium in the Project by any Owner or Occupant, nor shall it be interpreted to disallow an
<br />Owner from trading the temporary use of its Condominium for the right to use another dwelling on a
<br />temporary basis, provided the frequency of such exchange is in accordance with the Rules.
<br />B. No health care facilities operating as a business or charity shall be permitted
<br />in the Project, unless permitted by law or ordinance which preempts this restriction.
<br />C. No family day care home shall be permitted within the Project except as
<br />specifically authorized by California Health and Safety Code §1597.40 and other applicable state
<br />statutes. The owner /operator of any such day care facility shall comply with all local and state laws
<br />regarding the licensing and operating of a day care home and, in addition, shall:
