6. 1. B. - Page 75 <br />(1) Name the Association as an additional insured on the liability insurance <br />policy or bond carried by the owner /operator of the day care home; <br />(2) Defend, indemnify and hold the Association harmless from any liability <br />arising out of the existence and operation of the day care home; <br />(3) Abide by and comply with all of the Association's Rules; <br />(4) Supervise and be completely responsible for children at all times while <br />they are within the project; and, <br />(5) Cooperate with the Association if the Association's insurance agent or <br />carrier requires proof of insurance, proof of the agreement of the owner or operator of the day care <br />home to these conditions, or other reasonable requests. <br />7.2. Nuisances: No noxious, illegal, or seriously offensive activities shall be carried on <br />within Condominium, or in any part of the Project, nor shall anything be done thereon that may be or <br />may become a serious annoyance or a nuisance to or which may in any way interfere with the quiet <br />enjoyment of the Owners' Condominiums, or which shall in any way increase the rate of insurance <br />for the Project, or cause any insurance policy to be cancelled or to cause a refusal to renew the <br />same, or which will impair the structural integrity of any Building other portion of the Project. The <br />Board is entitled to determine if any device, noise, odor, or activity constitutes a nuisance. <br />7.3. Allowed Vehicles and Parking: Except as otherwise provided in this Section 7.3, <br />only "Allowed Vehicles" shall be parked, stored or operated within the Project. <br />A. Allowed Vehicles shall mean appropriately licensed passenger automobiles, <br />sports utility vehicles, motorcycles, and trucks having carrying capacity of % ton or less, vans having <br />seating capacity of eight (8) persons or less. Owners and/or Occupants shall park their Allowed <br />Vehicles only in the parking space appurtenant to or assigned to their Unit. Vehicles that are not <br />Allowed Vehicles shall not be parked or stored in the Project, except for commercial vehicles or <br />construction equipment that are providing services to a Unit or the Association (but only during the <br />period of time in which such services are being provided and subject to the Rules). Allowed Vehicles <br />shall not include any commercial vehicle, construction equipment, trailer, camper, mobile home, <br />recreational vehicle, truck having carrying capacity of greater than 3 / ton, van having seating <br />capacity in excess of eight (8) persons or any vehicle which is too large to fit within the Owner's <br />assigned parking space, inoperable or abandoned vehicles, boats or similar equipment. Allowed <br />Vehicles that are used both for business and personal use are not prohibited, provided that any <br />signs or markings of a commercial nature on such vehicles shall be unobtrusive and inoffensive as <br />determined by the Board. No excessively noisy or smoky vehicles shall be operated on the Project. <br />No Owner or Occupant of any Unit shall park more Allowed Vehicles within the Project at any <br />one time than the number of parking spaces assigned to that Owner. The Association may <br />establish parking rules and requirement, including requirements that Owners and Occupants shall <br />register their vehicles with the Association and shall display a parking sticker, card, or other form of <br />parking identification at all times. <br />B. No parking shall be permitted within the Project except in the parking spaces <br />designated for the use of the Owner or the Occupant of a Unit. No Owner or Occupant of any Unit <br />shall park more vehicles in the Project other than the number of parking spaces assigned to the Unit <br />that is occupied by the Owner or the Occupant. No parking shall be permitted within, or interfere with <br />the use of, the drive aisles or ramps of the Project.
