6. 1. B. - Page 77 <br />Unit in areas accessible to wildlife, and signs shall also be posted accordingly. Additionally, all <br />exterior trash receptacles shall be designed and maintained to exclude wildlife. <br />B. Except as provided in the Governing Documents, no animals of any kind shall <br />be raised, bred, or kept in any Condominium, or on any other portion of the Project. Subject to the <br />provision of this Section 7.5, Owners or Occupants of Units may keep no more than one (1) dog, or <br />two (2) cats, or one (1) dog and one (1) cat, within a Unit, and may keep a reasonable number (as <br />determined by the Board) of other ordinary household pets and fish that are kept in cages or <br />aquariums, provided that no such dogs, cats or other animal or fish may kept, bred, board, or <br />maintained for any commercial purposes. All pets shall be kept under reasonable control at all <br />times. No pets shall be allowed in the Common Area except as may be permitted by Rules of the <br />Board. No Owner or Occupant shall allow his dog or cat to enter the Common Area except on a <br />leash or in a pet carrier. <br />C. Subject to the provisions of this Section 7.5, trained dogs used for assistance <br />by visually impaired, hearing impaired or physically handicapped persons, or certified companion <br />animals prescribed by a physician, may be kept by an Owner or Occupant. <br />D. After making a reasonable attempt to notify the Owner or Occupant, the <br />Association or any Owner may cause any pet found within the Common Area in violation of the <br />Rules of the Board or this Declaration to be removed by the Association (or any Owner) to a pound <br />or animal shelter under the jurisdiction of the City or County by calling the appropriate authorities, <br />whereupon the Owner or Occupant may, upon payment of all expenses connected therewith, <br />repossess the pet. Owners or Occupants shall prevent their pets from soiling all portions of the <br />Common Area and shall promptly clean up any waste left by their pets. Owners or Occupants shall <br />be fully responsible for any damage caused by their pets. <br />E. Owners or Occupants shall use reasonable efforts to prevent any animal <br />within his Unit from making disturbing noises that can be heard from any other Unit. An Owner or <br />Occupant in violation of this Section may be deemed to be permitting, or causing a serious <br />annoyance or nuisance to any other Owner. The Board, after notice and a hearing, may require the <br />permanent removal of any animal that the Board determines to be a danger to the health and safety <br />of any Occupant in the Project, or otherwise to be a nuisance within the Project. The Board may find <br />that an animal is a nuisance if the animal or its' owner continue to violate the Rules regulating pets <br />after receipt by the Owner or Occupant of a written demand from the Board to comply with the <br />Rules. <br />F. In no event shall any Owner or Occupant authorize, bring or keep within the <br />Project any other breed known as a "fighting breed ": including any Pit Bull, Rottweiler, Doberman <br />Pinscher, Mastiff, Presa Canario, or any dog being a mix thereof. In no event shall any Owner or <br />Occupant authorize, bring or keep within the Project any snakes, pigs, large lizards, spiders, rats or <br />other vermin. <br />G. The Association may adopt additional Rules regarding the keeping of pets in <br />the Project. The Board, after notice and a hearing, may require the permanent removal of any <br />animals, birds or fish that the Board determines to be a danger to the health and safety of any <br />Occupant in the Project, or otherwise to be a nuisance within the Project. <br />7.6. Garbage and Refuse Disposal: All rubbish, trash recycling materials and garbage <br />shall be regularly removed from the Units, and shall not be allowed to accumulate therein.
