<br />A. Specifically, no building, fence, wall, pool, spa, obstruction, outside orexterior
<br />wiring, balcony, screen, patio, patio cover, tent, awning, carport, carport cover, trellis, or other
<br />improvements or structures of any kind shall be commenced, installed, erected, painted or
<br />maintained within a Unit, and no alterations, modifications, renovation, additions or other
<br />improvements of any kind shall be made thereto, or to the exterior of any Unit, until the same has
<br />been approved in writing by the Board, or by an Architectural Control Committee. As set forth in
<br />Section 7.9.G, the Declarant shall have the right to appoint an Architectural Control Committee. If the
<br />Declarant does appoint the Architectural Control Committee, the Board shall undertake the review
<br />and approval functions set forth in this Section 7.9. After such time as Declarant no longer has the
<br />power or relinquishes the power to appoint members to the Architectural Control Committee, the
<br />review functions provided in this Article shall be undertaken by the Board or by an Architectural
<br />Control Committee appointed by the Board under Section 7.9.G if the Board elects to establish and
<br />appoint an Architectural Control Committee.
<br />B. Solar Energy System: The Architectural Control Committee shall not restrict
<br />or prohibit the installation or use of a solar energy system that is protected by law, including, without
<br />limitation, California Civil Code §§ 714, 714.1 and 801.5, except that it may adopt reasonable
<br />restrictions which do not significantly increase the cost of the system or significantly decrease its
<br />efficiency or specified performance, or which allow for an alternative system of comparable cost,
<br />efficiency, and energy conservation benefits.
<br />C. Plans: Plans and specifications showing the nature, kind, shape, color, size,
<br />materials and location of any proposed improvements or alterations that require review hereunder
<br />shall be submitted to the Board or to the Architectural Control Committee forapproval as to quality of
<br />workmanship and design and harmony of external design with existing structures, and as to location
<br />in relation to surrounding structures, topography, and finish grade elevation, and conformity to the
<br />Design Guidelines.
<br />D. Painting and Decorating of Units: No permission or approval shall be
<br />required to paint or decorate the interiors of a Unit, or to rebuild in accordance with Declarant's
<br />original plans and specifications.
<br />E. Floor Coverings: In order to maintain noise transference levels between
<br />Units, and to comply with applicable building standards, floor covering materials that are replaced
<br />shall be replaced only with materials of equal or better quality and noise transmission specifications.
<br />[See Section 7.22 (Sound Transmission Restrictions).] Any such replacements shall be reviewed by
<br />the Board or by an Architectural Control Committee appointed by the Board.
<br />F. Landscaping: No landscaping shall be made or added to any Exclusive Use
<br />Common Area which is visible from the street or from the Common Area by any Owner until plans
<br />and specifications showing the nature, kind, shape and location of the materials shall have been
<br />submitted to and approved in writing by the Board or by an Architectural Control Committee
<br />appointed by the Board.
<br />G. Architectural Control Committee: The Architectural Control Committee
<br />shall consist of three (3) Members. Declarant may appoint all of the original members of the
<br />Committee and all replacements until the first anniversary of the issuance of the original Final Public
<br />Report. The Declarant reserves to itself the power to appoint a majority of the members to the
<br />Committee until ninety percent (90 %) of all the Condominiums in the Project, if any, have been sold
<br />or until the fifth anniversary of the issuance of the Final Public Report, whichever occurs first. After
<br />one (1) year from the date of issuance of the original Public Report, Board shall have the power to
