6.1. B. - Page 88 <br />Condominium or in, on or to the Common Area that may impair or alter fire sprinklers within the <br />Units or their source of water. <br />7.25. Water Supply System: No individual water supply, sewage disposal or water <br />softener system is permitted in any Condominium unless such system is designed, located, <br />constructed and equipped in accordance with the requirements, standards, and recommendations <br />of any water district having jurisdiction, the City, the Committee and all other governmental <br />authorities with jurisdiction. <br />7.26. View Obstructions: Each Owner acknowledges that: (a) there are no protected <br />views in the Property, and no Condominium is assured the existence or unobstructed continuation of <br />any particular view; and (b) any construction, landscaping (including the growth of landscaping), or <br />other installation of improvements by Declarant, other Owners or Owners of other property in the <br />vicinity of the Property may impair the view from any Condominium, and the Owners are deemed to <br />have consented to such view impairment. <br />7.27. Rights of Disabled: Subject to Section 7.9, each Owner may modify his Unit and <br />the route over the Common Area leading to the front door of his Unit, at his sole expense, to <br />facilitate access to his Unit by persons who are blind, visually impaired, deaf or physically disabled, <br />or to alter conditions which could be hazardous to such persons in accordance with California Civil <br />Code § 1360 or any other applicable law. <br />7.28. Roof Access: Access to the roofs of the Buildings shall be restricted to Persons <br />authorized by the Board. <br />7.29. Smoking Restrictions: Smoking shall not be permitted in any indoor (enclosed) <br />portion of the Common Area, at anytime, including, but not limited to, the courtyard, elevators, stairs, <br />garage, or hallways, provided however that smoking is permitted within Exclusive Use Common <br />Area Balconies or Patios provided that occupants of neighboring Units are not disturbed. <br />7.30. Moving In /Out and Contractor Rules: The Board may adopt Rules regulating the <br />moving of property in and out of a Condominium and means of ingress and egress to and from the <br />Condominium. The Rules may include, but are not limited to, Rules regarding the times during <br />which moving in or out may occur, coordination of two or more moves occurring within the same <br />time period, protection for the elevator cabs (if applicable), disposal of moving boxes, and the <br />payment of fees or posting of collateral or security to pay for damage to the Common Area. In <br />addition, the Board may adopt Rules regulating any construction work performed within a Unit, <br />including remodeling or upgrading. The Rules may include, but are not limited to, Rules regarding <br />construction times, protection for the elevator cabs (if applicable), disposal and storage of <br />construction materials and equipment, construction access routes, and the posting of collateral or <br />security to pay for any damage to the Common Area. <br />7.31. Electric Vehicle Charging Stations: Notwithstanding anything contained in this <br />Declaration to the contrary, any provision in the Governing Documents that effectively prohibits or <br />restricts the installation or use of an electric vehicle charging station is void and unenforceable. <br />Provisions that impose responsible restrictions on electric vehicle charging stations that are in <br />compliance with Civil Code section 1353.9 are not prohibited. <br />44 <br />03/06/12 <br />TAWPWIN601PR0JECTS1333 MAIN STREETIDEC - DRAFTING FORM[7][03 06 12].doc <br />
