6. 1. B. - Page 87 <br />E. In order to prevent leaks and to reduce the presence of mold, fungi, spores, <br />pollens and other botanical substances, or other allergens (collectively "Mold ") within the Unit, the <br />Owners shall inspect the interior of their Units not less frequently than once each quarter to check <br />for water leaks or other breaches of the watertight integrity of the improvements, and for the <br />presence of Mold. If any water leaks and/or Mold are detected within the Unit, the Owner shall <br />immediately notify the Board and take appropriate corrective steps to repairthe leak, and/or remove <br />the Mold and to maintain proper ventilation within enclosed areas, and to maintain humidity levels to <br />reduce the risk of Mold growth, and take such other prudent steps as may be appropriate to prevent <br />leaks and Mold growth, or eliminate any existing Mold. <br />F. In the event the Owner fails to cant' out such inspection and maintenance <br />within said period, the Board may, following notice and hearing as provided in the Bylaws, cause <br />such work to be done and the cost of the work shall immediately be paid by such Owner to the <br />Association as a Reimbursement Charge, and until paid shall bear interest at the rate of twelve <br />percent (12 %) per annum (but no greater than the maximum rate authorized by law) from the date <br />the cost was incurred by the Association until the date the cost is paid by the Owner. <br />G. In the event an Owner fails to inspect and maintain the interior of his Unit or <br />the landscaping within his private yard area in a manner which the Board deems necessary to <br />preserve the appearance and value of the Project, the Board may notify Owner of the work required <br />and request it be done within sixty (60) days from the giving of such notice. <br />7.22. Sound Transmission Restrictions: <br />A. No alteration or replacement of the floor or floor covering materials originally <br />installed in the Units shall be permitted except with the consent of the Architectural Control <br />Committee. The Board may adopt Rules pertaining to the type and sufficiency of floor covering in a <br />Unit to adequately reduce transmission of sound between Units or other portions of the Project. <br />B. Caution is recommended for alteration of any wall in the Unit. It is necessary <br />to have limitations regarding such walls to minimize transmission of sound andlor vibration between <br />Units and to protect against installation of equipment and devices that are of greater weight than the <br />weight which the wall system was designed to carry. The following limitations shall apply to affixing <br />or installing equipment, including but not limited to televisions, speakers and other such equipment, <br />to the walls of a Unit: <br />(1) No recessed or affixed speakers or noise /vibration- emitting device shall <br />be affixed or attached to (mechanically fastened) to any Demising Wall. Caution is recommended <br />for alteration of any wall in the Unit — not just Demising Walls. <br />(2) No televisions of any type shall be affixed to any Demising Wall or <br />ceiling of a Unit. A Demising Wall or ceiling of a Unit cannot be cut or opened to allow for wiring or <br />cabling for any purpose (such as entertainment, communications, networking, or electrical <br />transmission.) <br />7.23. Fire Separator Wall Limitations: The perimeter walls of Units are fire separations <br />forthe Project. No penetrations shall be made to any such perimeter walls of Units, such as drilling, <br />nailing, installation of molly bolts, and similar acts. <br />7.24. Fire and Barbeque Restrictions: No Owner or other resident of the Project may <br />store any flammable materials on any Exclusive Use Common Area Balcony or Patio. Furthermore, <br />no exterior fires of any kind, including those contained in barbecue grills, shall be permitted in any <br />Unit or on any Exclusive Use Common Area Balcony or Patio.
