<br />and times set forth in the City of Redwood City's Noise Regulation Ordinance so that
<br />the Property may be used as community open space Monday through Saturday
<br />evenings when not being used by Towne Ford and all day Sunday. Permittee's rights
<br />and duties under this Permit include the pruning of the trees and pest cintrol
<br />maintenance. Permittee shall perform such installation and maintenance so as not to
<br />unreasonably interfere with Towne Ford's Permit to use the Property as an employee
<br />parking lot between 7:00 a.m. to 6:00 p.m., Monday through Saturday. Use of the
<br />Property shall commence on the effective date hereinabove specified, on a month -to-
<br />month basis, and shall be terminable pursuant to paragraph 2 hereunder.
<br />2. Temoorary Permit. This Permit is temporary in nature, and does not
<br />constitute a deed, grant, of easement or lease, or other conveyance of any right, title, or
<br />interest in or to the Property. The Agency or Permittee, respectively, as terminating
<br />party may terminate this Permit at any time during which it is in effect by giving notice
<br />thereof to the non - terminating party not less than thirty (30) days prior to the effective
<br />date of termination.
<br />3. Installation and Maintenance. As consideration for this Permit, Permittee
<br />shall pay for the costs of installing and maintaining irrigation system, and landscaping,
<br />including but not limited to, vines and trees along the fence bordering Redwood Creek
<br />culvert, and trees along the outer curb edge of Lathrop Street. Permittee also shall pay
<br />for the costs of installing two pedestrian paths on the Property, driveway, curb and
<br />gutter along Lathrop Street, and decompressed granite surfacing material.
<br />4. Condition of Premises. Permittee shall, at its own cost and expense, keep
<br />and maintain the Property including, but not limited to, the landscaping and irrigation,
<br />and any equipment placed or stored thereon, in reasonable order and repair. Permittee
<br />also shall keep all portions of the Property clean, neat, orderly and free of papers,
<br />debris, wastes of other articles or things which increase the danger of fire or detract
<br />from the aesthetic appearance of the Property. Permittee shall, at its own cost and
<br />expense, conduct all operations on, and use of, the Property in such manner as to
<br />avoid discharging dust, solids, fumes, odors, gases or liquids into or on the Property, or
<br />otherwise into the environment so as to pollute the same.
<br />Permittee shall not bring or store upon the Property any hazardous waste,
<br />materials or things. Without limitation on the foregoing, Permittee shall, at Permittee's
<br />sole cost and expense, immediately remove and properly dispose of any and all
<br />hazardous wastes, materials, or other things or objects prohibited hereunder which may
<br />have been deposited in, upon or over the Property arising from Permittee's use and
<br />occupancy thereof. In the event any such hazardous materials, wastes, or other
<br />prohibited thing or object is deposited on the Property by Permittee, or is otherwise so
<br />deposited from Permittee's use and occupancy thereof, Permittee shall immediately
<br />notify Agency of such event, and shall, as aforesaid, immediately commence removal
<br />thereof. Said removal shall be subject to the requirements of Agency, and the Property
<br />shall be restored to a condition substantially conforming to that existing prior to the
<br />Atty /Permits /Permit.008 2
