q. I E <br />occupancy thereof by Permittee. <br />5. Aaencv Access. Agency reserves the right to unlimited access to the <br />Property or any part thereof for any purpose in furtherance of Agency's use of the <br />Property. Agency's use shall include, but is not limited to, Towne Ford's entrance and <br />use of the Property as an empi:)yee parking lot between 7:00 a.m. to 6:00 p.m., <br />Monday through Saturday. Notwithstanding the foregoing, Agency shall extend <br />reasonable efforts not to interfere with Permittee 's use of the Property in exercising its <br />rights under this paragraph. <br />6. Improvements. Permittee shall not make, nor cause to be made, nor <br />allow to be made, alterations or improvements to the Property not hereinabove <br />specified (including installation of any fixture affixed to the Property), without the prior <br />written consent of Agency. All improvements or alterations constructed or installed <br />shall be removed and the Property restored to substantially the same condition existing <br />prior to such construction or installation, upon the termination or revocation of this <br />Permit, unless the prior written approval of Agency is secured, allowing such <br />improvements or alterations to remain in place, in which case, title thereto shall vest in <br />Agency. All improvements undertaken pursuant to this Permit will be at Permittee's <br />sole expense and Permittee will be responsible for the use and care of the <br />Improvements. <br />7. Signs. Permittee shall not construct, place, nor erect any signs in, upon <br />or over the Property without the prior written consent of Agency. <br />8. Holdover. If, upon expiration or revocation of this Permit, Permittee <br />remains on the Property, Agency may remove any of the improvements placed upon <br />the Property by Permittee without written notice to Permittee. Permittee waives all <br />claims against Agency for any loss of revenue or damage to the improvements resulting <br />from Agency's retention or disposition of any of the improvements. Permittee is liable <br />to Agency for Agency's costs for storing, removing, or disposing of any of the <br />improvements. <br />9. Waiver of Claims. Permittee waives all claims against Agency and the <br />City of Redwood City ( "City "), their boards, councils, agents, officers or employees for <br />any damages to the Improvements in, upon or about the Property and for injuries to any <br />employees of Permittee or their agents in or about the Property from any cause arising <br />at any time. Agency assumes no responsibility for the guarding or safekeeping of the <br />Property, equipment, or improvements installed or constructed by the Permittee upon, <br />or used in connection with, the Property. <br />10. Indemnification. Permittee will hold Agency and City, their boards, <br />councils, agents, officers or employees exempt and harmless from any damage or <br />injury to any person, or any property, from any cause of action arising at any time from <br />the use of the Property by Permittee, or from the failure of Permittee to keep the <br />Atty /Permits /Permit.008 3 <br />102203 <br />
