6 1 e., 6 <br />5. Aoencv Access. Agency reserves the right to unlimited access to the <br />Property or any part thereof for any purpose in furtherance of Agency's use of the <br />Property. Agency's use shall include, but is not limited to, Irvine's entrance and use of <br />the Property for installation of landscaping, irrigation and other improvemems and the <br />maintenance thereof. Notwithstanding the foregoing, Agency shall extend reasonable <br />efforts not to interfere with Permittee's use and occupancy of the Property in exercising <br />its rights under this paragraph. <br />6. Improvements. Permittee shall not make, nor cause to be made, nor <br />allow to be made, alterations or improvements to the Property (including installation of <br />any fixture affixed to the Property), without the prior written consent of Agency. All <br />improvements or alterations constructed or installed shall be removed and the Property <br />restored to substantially the same condition existing prior to such construction or <br />installation, upon the termination or revocation of this Permit, unless the prior written <br />approval of Agency is secured, allowing such improvements or alterations to remain in <br />place, in which case, title thereto shall vest in Agency. All improvements undertaken <br />pursuant to this Permit will be at Permittee's sole expense and Permittee will be <br />responsible for the use and care of the improvements. <br />7. Signs. Unless otherwise noted, Permittee shall not construct, place, nor <br />erect any signs in, upon or over the Property without the prior written consent of <br />Agency. Permittee shall reimburse Agency two- hundred dollars ($200.00) for the <br />installation of two (2) "no public parking" signs to be placed at the entrance to the <br />Property. Agency shall have the two signs installed and reserves the right to determine <br />language and placement of the two signs. <br />8. Holdover. If, upon expiration or revocation of this Permit, Permittee <br />remains on the Property, Agency may remove any of the vehicles or improvements <br />placed upon the Property by Permittee without written notice to Permittee. Permittee <br />waives all claims against Agency for any loss of revenue or damage to the vehicles or <br />improvements resulting from Agency's retention or disposition of any of the vehicles or <br />improvements. Permittee is liable to Agency for Agency's costs for storing, removing, <br />or disposing of any of the vehicles or improvements. <br />9. Waiver of Claims. Agency assumes no responsibility for the guarding or <br />safekeeping of the Property, equipment, or improvements installed or constructed by <br />the Permittee upon, or used in connection with, the Property. Permittee waives all <br />claims against Agency and the City of Redwood City ( "City "), their boards, councils, <br />agents, officers or employees for any damages to any vehicles, improvements in, upon <br />or about the Property and for injuries to any employees of Permittee or their agents in <br />or about the Property from any cause arising at any time. <br />Atty /Permits/Permit.007 3 <br />102203 <br />
