q. I E 17 <br />Concurrently with the execution of this Permit, Permittee will furnish Agency with <br />certificates and copies of information or declaration pages of the insurance required <br />hereunder and, with respect to evidence of commercial general liability and automobile <br />liability insurance coverage, original endorsements: <br />(a) Precluding cancellation or reduction in coverage before the expiration of <br />thirty (30) days after Agency shall have received written notification of <br />cancellation or reduction in coverage by first class mail; <br />(b) Providing that Permittee's insurance shall apply separately to each <br />insured against whom claim is made or suit is brought, except with respect <br />to the limits of the insurers liability (cross liability endorsement); <br />(c) Naming Agency and City, and their boards, councils, officers, employees, <br />and agents, as additional insureds; and <br />(d) Providing that Permittee's insurance coverage shall be primary insurance <br />with respect to Agency and City, and their boards, councils, officers, <br />employees, and agents, and any insurance or self - insurance maintained <br />by Agency or City for themselves, and their boards, councils, employees, <br />or agents shall be in excess of Permittee's insurance and not contributory <br />with it. <br />If Permittee fails to maintain any of the insurance coverage required herein, then <br />Agency will have the option to revoke this Permit, or may purchase replacement <br />insurance or pay the premiums that are due on existing policies in order that the <br />required coverage may be maintained. Permittee is responsible for any payments <br />made by Agency to obtain or maintain such insurance and Agency may collect the <br />same from Permittee or deduct the amount paid from any sums due Permittee under <br />this Permit. <br />13. Compliance with Laws. Permittee shall comply with all laws concerning <br />use and occupancy of the Property including, without limitation, the obligation at <br />Permittee's cost to maintain or restore the Property, improvements, or the equipment <br />stored thereon, in compliance with, and in conformance to, any and all laws relating to <br />the condition, use, or occupancy of the Property or the storage and use of said <br />equipment. <br />14. Assignment. Permittee understands and acknowledges that assignment, <br />sublicensing or transfer of this Permit is absolutely prohibited without the written <br />consent of Agency, and any attempt to do so without Agency's written consent may <br />result in a revocation of the Permit at the will of Agency. <br />Atty /Permits /Permit.007 5 <br />102203 <br />
