FXS:dft 5/04/95 (004/73) <br /> 5/09/95R <br /> 5/17/95R <br /> FXS:rg 6/20/95R <br /> 7/06/95R <br /> 7/20/95R <br /> "I am aware of the provisions of Section 3700 of the <br /> <br /> Labor Code which requires every employer to be insured <br /> against liability for workers' compensation or to <br /> undertake self-insurance in accordance with the <br /> provisions of that Code, and I will comply with such <br /> provisions before commencing the performance of the <br /> work of this Contract." <br /> <br /> CM/GC shall be responsible for, and shall obtain and file <br />evidence of coverage on behalf of all his/her Subcontractors. <br />All such evidence shall be filed with the City Clerk. Should any <br />such policy be cancelled before final completion of the work <br />herein contemplated, and should CM/GC fail to immediately procure <br />other insurance as herein required, then City may procure such <br />insurance and deduct the cost thereof from the amount due the <br />CM/GC. 21. COMPLIANCE WITH LABOR LAWS. (a) CM/GC shall <br />comply and shall cause compliance with all applicable provisions <br />of Section 1810 to 1815, inclusive, of the California Labor Code <br />relating to working hours. CM/GC shall, as a penalty to City, <br />forfeit Twenty Five and No/100 Dollars ($25.00) for each worker <br />employed in the execution of this Agreement by CM/GC or by any <br />Subcontractor for each calendar day during which such worker is <br />required or permitted to work more than 8 hours in any one <br />calendar day and 40 hours in any one calendar week, unless such <br />worker receives compensation for all hours worked in excess of <br />eight (8) hours at not less than 1-1/2 times the basic rate of <br />pay. <br /> <br /> (b) Pursuant to the provisions of California L~bcr Code, <br /> Section 1770 et seq., CM/GC and any Subcontractor under him/her <br /> <br /> 16 <br /> <br /> <br />
