Section 2. Use Permit UP2011- : The Planning Commission finds that: <br />. The project and improvements proposed by Use Permit <br />Application No. UP2011-47 are consistent with, conform to <br />the intent of, and will appropriately implement Zoning <br />Ordinance Article 4 for the Airgas Facility Relocation <br />Project; and <br />. The establishment, maintenance and operation of the project <br />and improvements proposed by Use Permit Application No. <br />UP2011 -4 ' will not, under the circumstances of this <br />particular case, be detrimental to the health, safety peace, <br />morals or general welfare of persons residing or working in <br />the neighborhood of the project, or b e detrimental or <br />injurious to property or improvements in the neighborhood of <br />the project, or to the general welfare of the City, because the <br />project has been found to be consistent with the community <br />goads established in the City's General Plan and Zoning <br />Ordinance. <br />Section 3. The Use Permit is hereby conditionally granted based on the <br />Planning Commission's consideration and reliance o n the Initial Study Mitigated <br />Negative Declaration IS /MIND) and in accordance with the plans, details and <br />descriptions contained therein, contained in the Resolution olution certifying said <br />ISMN (Attachment 2, attached hereto and incorporated herein by reference <br />and cond itioned upon the following Conditions of Approval: <br />CONDITIONS of APPROVAL: <br />1. Applicant shall implement and comply with all the project mitigation <br />measures described in the Initial Study Mitigated Negative Declamation <br />(IS/MND)for the Airgas Facility Relocation Project, adopted by the Planning <br />Commission by Resolution No. and on file with the Community <br />Development Department (EA-2011-06). <br />2. Applicant shall insure that all improvements substantially conform <br />to the project plains, prepared by Ware & Il alcomb and bier & Wright, submitted <br />on September 2, 2011, and related information submitted by Applicant, on fire <br />with Planning Services. <br />3. All modifications to said approved plans must be submitted to <br />Planning for review and approval prior to the issuance of a Building Permit. <br />Substantial modification of said approved plans, as determined by the <br />Community Development Director or his /her designee, may be subject to a new <br />Use Permit. <br />ATTY/RESO.2198/AIRGAS FOR USE PERMIT <br />EE1l;0112112 <br />Page 2 of <br />
