RAB:dft "'~8/95 (012/67) <br /> <br /> Exhibit "A" <br /> <br /> FIRST AMENDMENT TO JOINT POWERS AGREEMENT - SAN MATEO CABLE TELEVISION AUTHORITY <br /> <br /> RECITALS <br /> <br /> A. The undersigned are the member entities (the "Members") <br />of that Joint Power Authority ("JPA") known as the San Mateo <br />Cable Television Authority ("SAMCAT") created by agreement dated <br /> <br />June 27, 1989, pursuant to Government Code §6500 through §6518. <br /> B. The Members desire to amend the Agreement to allow <br /> <br />SAMCAT to have the authority to collect data, hold hearings, and <br />regulate cable television rates and other matters permitted by <br />the State and Federal regulations for local CATV franchising <br />authorities on behalf of the Members. <br /> <br /> NOW, THEREFORE, the Members agree to amend the Agreement as <br />follows: <br /> <br /> 1. Paragraph 1 -- "Purpose" is modified by adding <br />subparagraph "d" to read as follows: <br /> <br /> "d. Jointly collect data, hold hearings, and regulate <br /> CATV rates and other matters permitted by the <br /> State and Federal regulations for local CATV <br /> franchising authorities for the Members with the <br /> television franchisees of the Members". <br /> <br /> 2. Paragraph 5 -- "Powers" is modified by adding <br /> <br /> subparagraph "k" to read as follows: <br /> <br /> "k. Collect data, hold hearings, and regulate cable <br /> television rates and other matters permitted by <br /> the State and Federal regulations for local CATV <br /> franchising authorities with the cable television <br /> franchisee(s) of the Members". <br /> <br /> <br />
