NOW, THEREFQRE, BE IT RESC)LVED AS FOLLOWS: <br /> Sec#ion 1. The Pianning Commission finds that the above recitals are <br /> accurate and constitute findings in this matter and, together with the Staff Report <br /> and the application materials, including without limitation the IS/MND, <br /> develapment p(an, vesting tentative map, and all other documents, reports, <br /> studies, memoranda, maps, aral and written testimony, and materials in the <br /> City's fiile for the applications and the Project, and all adopted City planning <br /> dacuments relating ta the Praject and the property including the City's General <br /> Plan, Municipal Code, Zoning Ordinance, and other applicable City laws and <br /> regulations, and all associated approved and certified environmental documents, <br /> have together served as an adequate and appropriafie evidentiary basis for the <br /> findings and actions set forth in this Resolution. <br /> Section 2. Modifica#ior�: The Planning Commission finds that the <br /> proposec! development wiil provide an enviranment of physical and fur�ctional <br /> desirabiiifiy, in harmony with the character of the surrounding neighborhood as <br /> the project is consistent with the community goals established in the City's <br /> General Plan and Zoning Ordrnance. <br /> Section 3. Planned Developmenf PD2011-01: Subject to the Modification <br /> set forth in Sec#ion 4 below, adoptian of the Final IS/MND mitigation measures <br /> and Mitigation, Manitoring and Reparting Program and the conditians of approval <br /> hereto, the Planning Commission finds that: <br /> a. The projec# and improvements proposed by Planned <br /> Development Permit Applicatinn No. PD2011-01 are consistent <br /> with, conform to the intent of, and will appropriately implement <br /> Zoning Ordinance Article 46 for the 1410 Valota Roa� <br /> Residential Project because the project is consistent with the <br /> community goals established in the City's Generai Plan and <br /> Zoning Urdinance. <br /> b. The establishment, maintenance and operation of #he 1410 <br /> Valata Road Residential Project and improvements proposed by <br /> Planned Development Permit No. PD2Q11-01 will nat, under fhe <br /> circumstances of this particular case, be detrimental to the <br /> health, safety peac�, morals or genera! welfare of persons <br /> rssiding or working in the neighborhood of the project, or be <br /> detrimental or injurious ta property or improvements in the <br /> neighborhood of the project, or to the general welfare of the <br /> City, because, subject to the Modification set forth in 5ection 4 <br /> below, the 1410 Valata Road Residential Project is consistent <br /> with the community goals established in the City's Genera( Plan <br /> and Zoning Ordinance. <br /> ATTYlRESQ.2211/1410 VALOTA RD — PD PERMiT <br /> REV:04-23-12 VR <br /> Page 2 of 9 <br />
