40. Basements, habitable attics, and every sleeping room shail hava at <br /> least one operable emergency escape and rescue opening. Where emergency <br /> escape and rescue openings are provided they shall have a sil! height of not <br /> rnore than 44 inches above the floor. Ali escape and rescue openings shall have <br /> a minimum net clear opening of 5.7 square feet. The minimum net clear opening <br /> height shall be 24 inches. The minimum net clear opening width dimension shall <br /> be 20 inches. {IRC R310) <br /> 41. A!i branch circuits that supply 120-volt, single phase, 15- and 20- <br /> ampere outlets installed in family rooms, dining rooms, living rooms, parlors, <br /> libraries, dens, bedrooms, sunrooms, recreation rooms, closets, hallways, and <br /> similar rooms or areas shall be protected by a combination type arc-fault circuit <br /> interrupter installed to provide protection of the branch circuit. (IRG E3902.11) <br /> 42. New and existing buildings shall have appraved address numbers, <br /> building numbers or approved building identification placed in a position fhat is <br /> plainly legible and visible from the street or road fronting the property. These <br /> numbers shall contrast with their background. Address numbers shall be Arabic <br /> numerals or alphabet fetters. Numbers shall be a minimum of 4 inches high with <br /> a minimum strake of 0.5 inch. Where access is by mearrs of a private road and <br /> the building cannot be viewed from the public way, a monument, pole or other <br /> sign or means shall be used to identify the structure. (iFC 505.1) In addition to <br /> approved address nurnbers placed on the buildings, a monument sign with the <br /> approved street addresses shall be placed at the private roadway entrance on <br /> Valota Road. <br /> 43. Applicant shall comply with all City, State and Federaf regulations, <br /> applicable #o the Praject. <br /> 44. Where a Planned Development (PD) Permit has not been used <br /> within one (1) yea� from the date of granting, either by beginning of construcfian <br /> of the improvements or by the initiation of the activity which is the subject of the <br /> PD Permit, said Permit shall automatically terminate and be of no further effect. <br /> 45. Pursuant to Section 66474.9(b) of the California Government Code, <br /> Applicant shali defend, indemnify, and hold harmless the C�ty, its agents, officers, <br /> and employees from any claim, action, or proceeding against the City or its <br /> agents, officers or empioyees, to attack, set aside, vaid, or annul an approval of <br /> the City, including but not limited to the Planning Comrnission, and the City's and <br /> Planning Commission's agents, officers or employees, concerning this <br /> subdivision, brought within the time period pravided for in Section 66499.37. <br /> The City shall promptly notify Applicant af any such claim, action or proceeding <br /> and shal! cooperate fully in the defense. <br /> 46.
