9. Conflict of Interest. City will evaluate Consultant's duties pursuant to this <br /> Agreement to determine whether disclosure under the Political Reform Act <br /> and City's Conflict of Interest Code is required of Consultant or any of <br /> Consultant's employees, agents, or subcontractors. Should it be <br /> determined that disclosure is required, Consultant or Consultant's affected <br /> employees, agents, or subcontractors will complete and file with the City <br /> Clerk those schedules specified by City and contained in the Statement of <br /> Economic Interests Form 700. <br /> Consultant, on behalf of Consultant and Consultant's agents, employees, <br /> subcontractors and consultants, warrants that by execution of this <br /> Agreement, that they have no interest, present or contemplated, in the <br /> projects affected by this Agreement. Consultant further warrants that <br /> neither Consultant, nor Consultant's agents, employees, subcontractors <br /> and consultants, have any ancillary real property, business interests or <br /> income that will be affected by this Agreement or, alternatively, that <br /> Consultant will file with the City an affidavit disclosing this interest. <br /> 10. Lobbvina Prohibited. Funds provided under this Agreement will not be <br /> used by Contractor for publicity or propaganda purposes designed to <br /> support or defeat legislation pending before federal, state, or local <br /> government. <br /> 11. R_elipious Activity Prohibited. There will be no religious worship, <br /> instruction, or proselytizing as part of, or in connection with, the <br /> performance of this Agreement. <br /> The following restrictions and limitations shall apply to the services <br /> rendered by Contractor in connection with the terms of this Agreement: <br /> (i) Contractor will not discriminate against any employee or applicant for <br /> employment on the basis of religion and will not limit employment or <br /> give preference in employment to persons on the basis of religion; <br /> (ii) Contractor will not discriminate against any person applying for a <br /> position related to the Project on the basis of religion and will not limit <br /> such services or give preference to persons on the basis of religion; <br /> (iii) Contractor will provide no religious instruction or counseling, conduct <br /> no religious worship or services, engage in no religious proselytizing, <br /> and exert no other religious influence related to the Project; <br /> (iv) The portion of a facilities related to the Project will contain no <br /> religious symbols or decorations. <br /> ATTY/AG R/2012.039/MC NABB <br /> REV:04-03-12 VR <br /> Page 15 of 16 <br />
