DES:d~' 01/04/95 (062/39) <br /> <br />all others interested in the matter testified or were given the <br />opportunity to testify; and <br /> <br /> WHEREAS, this Council has received extensive evidence that <br />said building constitutes a public nuisance as defined in <br /> <br />Section 9.6 of the Code of the City of Redwood City; <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br /> 1. This Council hereby finds and determines that that <br />certain building and appurtenances (hereinafter, "building" <br />includes appurtenances thereto) located at 309 Heller Street, <br />Redwood City, California, a single family dwelling, constitute <br />a public nuisance as defined by certain provisions of Section <br />9.5 of the Code of the City of Redwood City, as follows: <br /> <br />Redwood City Code (~9.5(a) <br /> [pertinent subdivisions <br />referenced hereinafter] Description of Condition <br /> <br /> (4) Portions of said building are likely to <br /> fail, or to become detached or dislodged, <br /> or to collapse and thereby injure persons <br /> or damage property; <br /> <br /> (6) A portion of the building has wracked, <br /> warped, buckled or settled to such an <br /> extent that walls or other structural <br /> portions have materially less resistance to <br /> winds or earthquakes than is required in <br /> the case of similar new construction; <br /> <br /> (7) The building, structure, or a portion <br /> thereof, because of (i) dilapidation, <br /> deterioration, or decay; (ii) faulty <br /> construction; (iii) the removal, movement <br /> or instability of any portion of the ground <br /> necessary for the purpose of supporting <br /> such building; (iv) the deterioration, <br /> decay or inadequacy of its foundation; or <br /> (v) any other cause, is likely to partially <br /> or completely collapse; <br /> <br /> 2 <br /> <br /> <br />
