7.C. - Page 12 <br /> (2} Situations where no reasonabfy feasible available alternafive exists �a a <br /> specifiic ar�d necessary container prohibited by this chapter. <br /> (b) The appEication process for exemption shall b� as fiollows: <br /> {'f} The faod �endor seeking an exernption shal[ submit a written exemption <br /> reques�to �he Environmental Health Division. <br /> (2} A written exem�tion request shafl include al1 i�farmation and documentafion <br /> necessary#or th,e Director of the En�irnnme�ta[ Health Di�ision to make a <br /> finding that impositian of this chap�er would cause an unt�u� hardship as <br /> defined ir� Section 4.107.050(a). <br /> {3) The Director of the Envira�me�ntal Healt� Di�ision may require the applicant <br /> to provide ad�itional informat�on in order to make a tl�termination regarding <br /> the exemption applicafion. <br /> (4} Exemption d�cisions are effective imrr�ediateiy and are final an�i not subject <br /> to appeal. <br /> (5) The Director of the Er��ironmental Health Division or his/her designee may <br /> �rant an exemp�io� for a periad of up to one year upon a finding that the faod <br /> vendor seeking the exemption has demonsfrateel thaf strict application of the <br /> specific requirem�ntwould cause undue hardship as defiir�ed in 4.�07.050 (a). <br /> {c) ff a faad �endor granted an exemption wishes ta have the exemp�ion exter�ded, it <br /> must re-apply for the exempf�on prior #o the expiration of the one year exemptior� <br /> period and demonsfrate confiinued uncfue hardship.
