Upon findings made un�er subsection (a), the foad vendor shalf <br /> be s�bject to an administrati�e fine as follaws: <br /> (1) A fine no� exceeding one hundred dollars {$10Q) for a fErst vio[ation; <br /> (2} A fine no# exceeding two hundred dalfars {$200) for a second viala#ion; <br /> {3) A fine not exceedeng five �undre� dallars ($500} for the third and subsequent <br /> viofations; <br /> (4) Eac� day that a food �er�dor uses polystyrene-based disposable food service <br /> ware when pro�iding pre�ared food shalf constitu�e a separa�e �iolation. <br /> (c) Fine Procedures. Notice of the fine shalf �e served on the fooci vendor. The notice <br /> shalf contain an advisemenf of the rigF�t to rec�uest a hearing before fhe Director of <br /> the Enviranmer�tai Health Di�ision or his or her design�e cor�tes�i�g the imposition <br /> of the firte. The grounds for the contest shall be either that {1} the food vendor cfid <br /> not �se pofystyr�ne-based disposable faod ser�ice ware wher� pro�idir�g prepared <br /> faod or (2) the food �enda�'wo�ld ha�e been granted an exempfion under <br /> 4.147.D50 if�he faod vendor had applied far sucf� exemption. Said hearing must be <br /> re�uesf�d within ten days of the date appearing on fhe notice of the fine. The <br /> decision of fhe Direcfor of the En�ironmental Hea[#h Diuision shaii be based upan <br /> a finding that one of t�e abaue list�d grounds for a contest ha�e been met and <br /> shall be a �inal administrati�e order, with no administrati�e right of appeal_ <br /> (d) Faii�are to Pay Fine.
