~ DES:djk 07 9/94 (030/39) <br /> 0 R I G 12 N A L 9/26/94 <br /> <br /> RESOLUTION NO. 12340 <br /> <br /> RESOLUTION SUMMARILY VACATING A PORTION OF A PUBLIC <br /> STREET, SLOPE EASEMENT AND NON-ACCESS RESTRICTION <br /> SUPERCEDED BY RELOCATION, SUBJECT TO THE RESERVATION OF <br /> A PUBLIC SERVICE EASEMENT AND NON-ACCESS RESTRICTION <br /> AND APPROVING AND AUTHORIZING ACCEPTANCE OF GRANT DEED <br /> AND DELIVERY OF QUIT CLAIM DEEDS PERTAINING THERETO <br /> <br /> (ORACLE PARKWAY - MARINE PARKWAY) <br /> <br /> WHEREAS, pursuant to the provisions of Chapter 4 (commencing <br />with §8330), Part 3, Division 9 of the Streets and Highways Code <br />of the State of California, this Council may summarily vacate a <br />street or easement if such street or easement has been superceded <br />by relocation and, as to the easement, there are no other public <br />facilities located therein; and <br /> <br /> WHEREAS, those portions of the street and easements <br />(including a non-access restriction) as shown on Lot I of that <br />certain map entitled "Centrum Office Park", filed July 24, 1989 <br />in Volume 120 of Maps at Pages 45-58, Official Records of San <br />Mateo County, are no longer be required for public use, provided, <br />that a portion of said street and non-access restriction shall be <br />relocated, but said slope easement shall be vacated; and <br /> <br /> WHEREAS, the owner of record of the property affected <br />thereby proposes to convey to the City, by grant deed, a <br />right-of-way and easements for public street and public utility <br />purposes in exchange for the portion of the public right-of-way <br />and street, easement and non-access restriction to be vacated; <br />and <br /> <br /> <br />
