(2) The HABITAT agrees to permit access to his records of <br />employment, employment advertisements, application forms, and other pertinent <br />data and records by the State Fair Employment Practices Commission, or any <br />other AGENCY of the State of California designated by the awarding authority, <br />for the purposes of investigation to ascertain compliance with the Fair <br />Employment Practices section of this contract. <br />D. Nondiscrimination Based on Disability. <br />HABITAT hereby agrees that it will comply with the provisions of Section 504 of <br />the Rehabilitation Act of 1973, as amended, providing equal access and <br />reasonable accommodations in employment programs and services to persons <br />who are disabled. <br />E. Interest of Public Officials. <br />No members, officers, employees, or agents of the CITY, or AGENCY and no <br />member of the CITY council or Board member, and no other public official who <br />exercises any function or responsibility with respect to this Agreement or <br />HABITAT's Program during his or his tenure, or for one year thereafter, shall <br />have any interest, direct or indirect, in this contract or a related subcontract, or <br />the proceeds thereof. HABITAT shall incorporate in all subcontracts hereunder a <br />provision prohibiting such interest. <br />F. Religious Activity Prohibited. <br />Those shall be no religious worship, instruction, or proselytizing as part of, or in <br />connection with, the performance of this Agreement. <br />G. Uniform Administration Requirements. <br />HABITAT shall comply with the requirements and standards of the HOME <br />Investment Partnership Regulations, OMB Circular A-122 Cost Principles for <br />Non -Profit Organizations, OMB Circular A-110 attachments A, B, C, F, H, N, and <br />0, and all other federal, state, and local laws, regulations and requirements, as <br />applicable. <br />HABITAT shall comply with the requirements and standards of the HOME <br />Investment Partnership Regulations relating to: income targeting to HOME limits <br />of 50% and below median income; affordability term of no less than 30 years; <br />recorded deed restrictions at the time of sale to a HOME eligible buyer which <br />provides for the recapture of HOME funds and first right of refusal in the event of <br />sale prior to the completion of the required affordability period; maximum sales <br />price not to exceed 95% of area median sales prices or $252,700, whichever is <br />Acquisition - 111 6 <br />FXS:fs <br />04/14/00 <br />
