A. Section 504 of the Rehabilitation Act of 1973
<br />(1) Pursuant to Section 514 (Public Law 93-112), the HABITAT agrees that
<br />no otherwise qualified persons with disabilities shall, solely by reason of a
<br />disability, be excluded from the participation in, be denied benefits of, or be
<br />subjected to discrimination in the performance of this contract or in the selection
<br />of low income owners to purchase the dwelling to be built on the Property.
<br />(2) Compliance of Section 504 of the Rehabilitation Act of 1973, as amended,
<br />requires that all benefits, aids and services are made available to persons with
<br />disabilities on an equivalent basis with those received by non -disabled persons.
<br />HABITAT shall agree to be in compliance with Section 504 requirements by
<br />developing a plan for compliance to be submitted to the Section 504 Coordinator
<br />as soon as possible but not later than by the close of escrow for this acquisition.
<br />B. Affirmative Action.
<br />HABITAT certifies that it is in compliance with the Equal Employment
<br />Opportunity Requirements of Executive Order No 11246, as amended by
<br />Executive Order No 1375, Title VII of the Civil Rights Act of 1964, the California
<br />Fair Employment Practices Act and any other federal or state laws pertaining to
<br />equal employment opportunity, and that it will not discriminate against any
<br />employee or applicant for employment or opportunity to purchase the dwelling to
<br />be built on the "property." on the basis of race, religion, color, national origin,
<br />ancestry, sex, age, physical or mental disability, marital status, sexual
<br />preference, or political affiliation in matters pertaining to occupancy, hiring,
<br />training, upgrading, transfers, compensation or termination.
<br />C. Fair Employment Practices
<br />(1) In the performance of this contract, the HABITAT agrees to not
<br />discriminate against any employee or applicant for employment because of race,
<br />religion, color, national origin, ancestry, sex, age, physical or mental disability,
<br />marital status, sexual -preference, or political affiliation. The HABITAT agrees to
<br />take affirmative action to ensure that applicants are employed, and that
<br />employees are treated during employment, without regard to their race, religion,
<br />color, national origin, ancestry, sex, age, physical or mental disability, marital
<br />status, sexual preference, or political affiliation. Such action shall include, but
<br />not be limited to the following: employment, upgrading, demotion or transfers;
<br />recruitment or recruitment advertising; layoff or termination; rates of pay or other
<br />forms of compensation; and selection for training, including apprenticeship. The
<br />HABITAT agrees to post in conspicuous places, available to employees and
<br />applicants for employment, notices to be provided by the CITY setting forth the
<br />provisions of this Fair Employment Practices section.
