7.A. - Page 8 <br /> The "Practice" section will be the detailed facilitation of working through the comparison <br /> of each proposal with the criteria. How do the elements of each align with the Council's <br /> vision? Finally, the "Do" section is the City Council's direction to staff to proceed with <br /> negotiating a Disposition and Development Agreement with the preferred development <br /> team. <br /> Next Steps <br /> Before the City Council can approve a Disposition and Development Agreement (DDA), <br /> in accordance with State law, both the Planning Commission and the City Council must <br /> hold a public hearing and make findings that the provisions of the DDA are consistent <br /> with the General Plan and the Downtown Precise Plan <br /> Additionally, staff believes that there is an opportunity to improve the design and use of <br /> the project site by moving some of the parking off site. Specifically, staff anticipates <br /> entering into discussions with the owners and operators of the Cinema project to <br /> determine if there are opportunities to maximize the use of that facility for public parking. <br /> Resolution of this parking discussion may affect the final design and land value. As <br /> such, a recommendation will accompany the final proposed DDA. <br /> It is the intent of staff and the developers to return to the City Council a soon as possible <br /> with a completed DDA. Given the legislatively required steps a date certain cannot be <br /> set at this time. <br /> ALTERNATIVES <br /> 1. Request additional information from the developers or staff. <br /> 2. Request additional time to consider the proposals before making a selection. <br /> FISCAL IMPACT <br /> The fiscal impact will vary depending on the nature of the business terms that are <br /> eventually agreed to with the chosen developer. <br /> ENVIRONMENTAL REVIEW <br /> This action does not constitute a"project" for purposes of CEQA, as that term is defined <br /> in CEQA Guidelines Section 15378. Once the details of the project are defined in a <br /> proposed Disposition and Development Agreement and prior to approval of the resulting <br /> DDA, staff will evaluate the project in compliance with CEQA.
