7.C. - Page 1 <br /> RE PO RT <br /> To the Honorable Mayor and City Council <br /> From the Cit Mana er <br /> May 21, 2012 <br /> SUBJECT <br /> General Plan Annual Report <br /> RECOMMENDATION <br /> Accept the Redwood City General Plan 2011 Annual Report and direct staff to forward <br /> the document to the State of California Department of Housing and Community <br /> Development and the Governor's Office of Planning and Research. <br /> BACKGROUND <br /> The General Plan Annual Report is intended to meet the reporting requirements of <br /> Government Code 65400(a)(2) and be consistent with the General Plan Annual <br /> Progress Report Guidance provided by the Governor's Office of Planning and Research <br /> (OPR). <br /> Government Code Section 65400(a)(2) requires jurisdictions to file an annual report <br /> addressing the status of their General Plan and progress made toward implementation <br /> of General Plan goals, policies, and programs, including progress in meeting its share of <br /> regional housing needs and efforts to remove governmental constraints to the <br /> maintenance, improvement, and development of housing. Only charter cities are <br /> exempt from the requirement to prepare annual reports on General Plans. Redwood <br /> City is a charter city, so it would be exempt from preparing the annual report. However, <br /> Section 71 of the Redwood City charter stipulates that all general laws that do not <br /> conflict with the charter or other ordinances are applicable: <br /> Redwood City Charter: Section 71. GENERAL LAWS APPLICABLE: <br /> All general laws of the state applicable to municipal corporations, including those <br /> relating to "municipal affairs," now or hereafter enacted, and which are not in <br /> conflict with the provisions of this charter or with ordinances or resolutions <br /> hereafter enacted shall be applicable to the city. <br /> As such, the City is completing this 2011 General Plan Annual Report to be consistent <br /> with State law and the Redwood City Charter. <br /> Pursuant to California Government Code Section 65400(a)(2) and Guidelines prepared <br /> by OPR, General Plan Annual Progress Report Guidance, the Annual Report must be <br /> submitted to the City's legislative body for review and acceptance.
