Developer is the cut-irent fee owner af that certain real property consisting of <br /> approxi�ately 0.70 acres located within the City of Redwoad City, County of San Mateo, Sfate af <br /> California, Iegally described in E�ibit A and depicted in E�iibit S, attac�ed hereto and incorporated <br /> herein by reference(the"Property"). <br /> B. The Downtawr�Precisa Plan r�quires that Developer construct and installs certain public � <br /> itnprovements, as more specifically identi�ed below. � <br /> � <br /> C. Developer has submitted to City p�ans, specifications ar�d drawings entitled 201 Marshall E <br /> Street Improvement Plans, prepared by BKF Engineers/Sujveyors/Planners and dated May 24, 2012 (t�e � <br /> "In�provernent Plans"), which, in addition to other improvennents, provide for cartain on-site public <br /> improverr�ants consisting of street and street lig�t improvements, stortn drain systems, domestic water � <br /> systems and sanitary sewer systems�or the Project(collecti�valy,"Improvements"}. � <br /> D. City and Developer desire to ent�r an agreerrient providing �or the construction and <br /> installation of tl�e Impravements in accordance wittt the Improvement Plans. <br /> AGREEMENT <br /> NOW, THEREFORE, in consideration of the faithful p�rFormance of the terms and condi�ions set <br /> forth in this Agreement,the parties hereto agree as follows: <br /> 1. Pu ose. The purpose of t�is Agreement is to guarantee completion of the Imgrovements <br /> and ensure satisfactory performance by Der�elo�er of Devetoper's obligations pertaining to the <br /> Icn.pravamen#s. <br /> 2. Dut,y to I�stall�inprovements. Develope�•will construct, install and complete, or cause ta <br /> be cons#rueted, installed and cotnpleted, at the Developer's sole cost and expense, the Improvemen�s, in <br /> accordanca with the Improvement Plans (de�ned in Recital C. abo�va) an.d to the satisfaction of�he City <br /> Engineer, in his reasonable discretion. Developer wili also supply all labor and materiais there�ar, all in <br /> strict accardance �;vith the terms and canditions of thzs Agreemant.
