In the <br /> event a conflict exists between the Plar�s and the requirernents of the Downtown�recise Plan,the shicter <br /> requiretnant or standard shalt gover�,as c�eter�nined by t1�e City Engineer. <br /> 3. Completion Date. Developer will complete the Work wit�in twenty (20} months <br /> following the Effective Date. All Wark will be completed in a goad and warkrnanlike �nanner in <br /> accordance with the T�nprovernent 1'lar�s. This cornpletio� date may be extended by City in its sole and <br /> absolute discretion at tha request of Developer, which request shall be accompanied by a written <br /> ass�rance aeceptable to the City Engineer that the securities required by Sectio� 13 shall rernain <br /> enforceable throughout the term of the extensio�. <br /> 4, Estimated Cost af Work. The engineer's estimated cost of the Work is Three Hundred <br /> Sixty S�Thousand Six Hundred Fifty and No/100 Dollars($366,650A0}("Estimated Cost of Work"}. <br /> 5. Modifications to the Plans. Approval of this Agreez�ent by City does not release <br /> Developar of its respansibi�ity to correct mistakes, errors or omissions in the Improvement Plans. If, at <br /> any time, in the opinion of the City Engineer, in his reasonable discr�tion, the Imp:rovement Plans are <br /> deemed inadequatie in any respect, Develope��ag�•ees to mat�e such modifications, changes or revisions as <br /> reasonably necessary in order to complete the Work in a good and workmanlike manner in accordance <br /> with accepted design and consh-uction standards and consistent with the Downtawn Precise Plar� and <br /> Improvement Plans. <br /> 6. Ret�airs. Developer agrees to repair ar have repaired in a ti�nely manner at its sole cost <br /> and expanse a11 public �•oads, streets, or other public or private property damaged as a result of or <br /> incidental to the Work or in connection with the developtnant of the Property. City shall be under no <br /> obligation whatsoever to accept the Work connpleted under this Agreement until such time as all repairs <br /> have been co�npleted or have been paid for. <br /> 7.
