Reference is made to that certain real property situated in the City of Redwood City, ', <br /> County of�an Mateo, State of California,known as the 201 Marshall Street site and described on Exhibit , <br /> "A", attached hereto and incorporated by this reference as if fully set forth herein (the "Property"). The ' <br /> Property is baing deveioped as an apar�ment project. ', <br /> B. In connection with its developme�t of the Proparty as a residential comrnunity, the ', <br /> Developer subrnitted to the City a PC Pez-�ait and Co�astruetio�n �lans, whick� include, inter alia, ' <br /> landscaping plans for along tt�e Property fron#age("1'lans"), all of which Plans have been approved by the <br /> City. The Plans provzde forr instal�ation o�certain landscaping, pedestrian lighting, irrigation piping a.nd <br /> controiler ("Irnprovements"} within that portion of the City righ�-of-way ("Maintenance Area") as tha <br /> I�provaments and Maintenance Area are more spaci�cally shown on Exliibit"B" attached hereto and by <br /> this reference made a pa��t hereof. <br /> C. The Developer has sub�ifted a fi�al map for 201 Marshall Si-reet, which has been <br /> reviewed by the City Engineer and is l�eing approved concurrently with this Agreement("Final Map"). <br /> D. The Developer recognizes that the City's approval of the Final Map is based on the <br /> Developer's commitment to ti�e iong-term maintanancs, repair, care and, if and when nec8ssary, <br /> replacement of the Improve�ents, and that the Final Map would not have been approved without the <br /> assurance that this Agreement would be executec�by the Developer. <br /> E.
