6.1.J. - Page 6 <br /> Improvements shall be in s�rict ca�apliance with the provisions of Chapt�r 30 of t1�e Redwaod City Cad�. <br /> In the event a conflict exisfs between the Plans and�he rec�uirements of Chapter 30 of the Redwood City <br /> Code,the stricter requirement or standa�rd shall govern,as determined by the City Engineer. <br /> 4, Completion Date. Developar wi11 cotxzplete tl�e Work within two years af the Effective <br /> Date. All Work �crvill be completed in a good and workmanlike mannar in accordance with accepted <br /> design and construction practices and consistent vvith fha �provement Plar�s. This completion date may <br /> be extended by City in its sole and absaiute discretion at�he request of Developer,which request shall be <br /> aeco�panied by a wriiten ass�zrance accepta�ble to the City Engineer that the securities required by <br /> Section 13 sha11 remain er�oroaable throughout the term of the e�ension. <br /> 5. Estimated Cost of �747ork. Th� angineer's estimated cost of the Work is roughly Six <br /> Hundred Eighiy Nine Thausand Three Hund�•ed Sixty Dollars($689,360.00){"Estimated Cast of Work"). <br /> 6. Modifications ta the Plans. Approval of this Agreement by City does not release <br /> Dev�loper o�'its responsibility to correct�istakes, errors or omissions in t�e Itx�provemant Plans. If, at <br /> any time, in the opinion of the City Engineer, in his reasonable discre�io�, the Tn�provement Plans are <br /> deemed inadequate in any respect, Davaloper agrees#o make sucl�madificatians, changes o�•revisions as <br /> necessary in order to com.plete the Work in a good and wor�nanlika ma.nt�ex in accordancs witl�accepted <br /> design and canstruct�on sta�dards and consistent�i�h tha Conditions and Impro�+ement Plans. <br /> 7. Repairs. Developer agrees ta repair or have repaired in a timely manner at its sole cost <br /> and expense al1 public raads, streets, or other public o�private property damaged as a resul� of the Work <br /> or in conr�ection with t�e development of the Property, or to pay�o tha property owner of any damaged <br /> road, street or property the fiY11 cost of such repair. In addition, Developer shall obtain the written <br /> accepfanca of suoh repair or paymenf from any owner whose private or public property was repaired by <br /> Developer or to whom Developer has paid the fu11 cost o£such repair in accorda�ce with this Section 7. <br /> City shall be under no obligatzon whatsoever to accept the Work cofnpleted under t1�is Agreement until <br /> such time as all repair� have been cornpleted or have been paid fax and wrii�en acceptances have be�n <br /> provided to the City Engineer. <br /> 8. �oxernan ar Su erintendent. Developer shall give personal attention to the Work. A <br /> co�npetent forema�►or s�perintendent, satisfacto�y to the City Engineer in his reasonable discretion wi�h <br /> authority to represent the Develope�•, sha11 be named in writing by Daveloper prior to commencement of <br /> the Wo:rk, shall be present on the Property during the performance of t�e Work and may not be changed <br /> without advance notifcation to tha City E�gineer. <br /> 9. Examination of Work. All of�he Work shall be consistent with the Irnprovement Plans <br /> and per�ormed to the satisfactior� of the City Enginest, in his reasonable discretion, City and ifs <br /> a�zthoz ized agents shall, at all times during the pe��orr�ance o£the Work,have free access to the Property <br /> and the Work and shall be allowed to examine the Work and ali materials used and to be used in the <br /> Wor�, <br /> 10. City Costs; Deposit. Develaper shall pay to Ci1y tha actual cost £or a11 engineering, <br /> iztspection, ad�inisi�atian, plan check, laboratory and �eld testing, constnzetion, and other services <br /> fiirnished by City in connection with this Agreement, incl�ding thosa perf'ormed by consultants under <br /> con�ract with City ("Ci�.y Costs"). Developer shalt deposit vv�ith City tha suzn o£Thirty Thousand and <br /> No/100 Dollars ($30,OQ0.00) ("Deposit")to compansate City for all City Costs. Developer understands <br /> that the Deposi�is an estirnate and fi�rther agrees to pay to City t�e actual cost of providing such services, <br /> in accordance�vwi�h the Ci�ty's current fees.
