City and Developer desire to enter an agreement providing for the construction and <br /> installation of t�e Improveme�ts in accordance with the Improvement Plans. <br /> AGREEMENT <br /> NOW, THEREFORE, in consideration of the faithful perFormance of the terms and conditions <br /> se�forth in this Agreement,the parties hereto agree as fallows; <br /> 1. Put�ose, The purpase of this Agreernent is to guaeantee coz�pletian of the Improvements <br /> and ensure satisfactory perfortnance by Developer af Developer's obligations to satisfy the Conditions <br /> pertaining to the Impravements, <br /> 2. Property Subject to A�reement. The Property shall be subject to this Agraernent. <br /> 3. Dutv to Install Improvemer�ts. Developer will construct, install and complete, or cause to <br /> be const�•ucted, installed and completed, at the Developer's sole cost and expense, the Improvements, in <br /> accordance with the Irnprovement Plans (defined in Recital E, abovej ar�d to the satisfaction of the City <br /> Engineer, in his reasanable discretion.
